HR ChatGPT Policy

Employee Identification

Position Information

Purpose and Scope

Purpose: This policy governs employee use of generative artificial intelligence tools, including ChatGPT and equivalent language models (collectively "AI Tools"), while performing duties on behalf of the organization. The policy sets mandatory controls to protect confidentiality, data integrity, intellectual property, and compliance with applicable legal and contractual obligations.

Scope: This policy applies to all employees, contractors, temporary staff, and third parties who access corporate systems, data, or communicate on behalf of the organization. Use of any AI Tool in the conduct of the organization's business or using corporate data is subject to the requirements below.

Definitions

"AI Tool" means any generative artificial intelligence system that produces text, code, images, or other outputs based on prompts, including cloud-hosted and on-premises systems. "Confidential Information" includes trade secrets, personally identifiable information (PII), protected health information (PHI), customer data, and other non-public business information.

Acceptable Uses

Employees may use approved AI Tools for tasks that include drafting non-confidential internal communications, generating templates, summarizing public-domain material, brainstorming, and supporting routine coding/debugging activities provided that the outputs are reviewed and validated by an appropriate human subject-matter expert prior to reliance.

Approvals: Use of AI Tools with client data, confidential internal records, employee PII, PHI, or contractual data requires prior written approval from the employee's manager and the Information Security team. To request an exception, complete the Manager Approval Description below and attach required justifications in the incident/exception tracking system.

Prohibited Uses

The following actions are prohibited when using AI Tools in any context involving the organization:

- Entering or uploading Confidential Information, PII, PHI, financial account numbers, or proprietary code into unsecured AI Tools or public prompts.

- Relying on AI Tool outputs for legal, regulatory, clinical, or safety-critical decisions without documented human validation and appropriate approvals.

- Representing AI-generated content as fact or as the organization’s official position without review and authorization from the appropriate business owner.

Data Handling and Confidentiality

Employees must not input Confidential Information or other restricted data into AI Tools that do not provide contractual protections and technical safeguards. When use is permitted under approved controls, employees must annotate outputs and record the source prompts and tool version to preserve traceability.

Intellectual Property and Attribution

Outputs generated by AI Tools may implicate third-party content or licensing terms. Employees must not incorporate AI-generated content into deliverables to clients or products without clearance from Legal. When AI Tools are used to create original content on behalf of the organization, ownership and licensing will be governed by existing intellectual property policies and agreements.

Accuracy, Human Oversight and Validation

Employees must verify factual assertions, legal conclusions, financial calculations, and technical recommendations produced by AI Tools. Validation steps and the identity of the reviewer must be documented in project records. The organization disclaims any liability for decisions made without documented human review.

Security Controls and Monitoring

Use of AI Tools on corporate networks is subject to monitoring and logging. Security will review logs to detect suspicious or unauthorized data transmissions. Employees consent to such monitoring as a condition of system access.

Incident Reporting

Any suspected unauthorized disclosure, data exposure, or policy violation involving an AI Tool must be reported immediately to Information Security and the employee's manager. Prompt reporting is required to enable containment, forensic review, and legal obligations.

Training and Competency

Employees must complete mandatory AI Tool training prior to using AI Tools for business purposes. Training covers data classification, privacy, validation, and reporting obligations.

Monitoring, Auditing and Enforcement

The organization reserves the right to audit AI Tool usage, prompt history, and associated artifacts. Violation of this policy may result in disciplinary action, up to and including termination, and may trigger legal response where laws or contracts are implicated.

At-Will Employment and Equal Opportunity

Use of AI Tools is subject to the organization's employment policies. Nothing in this policy alters the at-will nature of employment where such doctrine applies. The organization is an equal opportunity employer and will not tolerate discriminatory uses of AI Tools.

What the HR ChatGPT Policy Is and Why It Matters

An HR ChatGPT Policy defines permitted and prohibited uses of generative AI tools, including ChatGPT-style assistants, within human resources functions. It clarifies scope, data handling, recordkeeping, decision-support limits, and roles responsible for oversight. The policy aims to protect employee privacy, maintain nondiscrimination, ensure legal compliance, and provide guidance on when to escalate for human review.

Core Purpose and Practical Benefits

A clear HR ChatGPT Policy reduces legal and operational risk by setting boundaries for AI use, protecting sensitive data, improving consistency in HR processes, and documenting controls that support regulatory compliance and defensible decision-making.

Core Purpose and Practical Benefits

Who Needs This Policy and Who Will Use It

This policy is intended for HR teams, people managers, IT and security staff, legal counsel, and any employees who interact with generative AI in HR workflows.

  • HR leaders and people managers who approve or rely on AI-generated recommendations for hiring, performance, or discipline
  • IT, security, and privacy teams that configure access controls, data classification, and vendor risk assessments
  • Legal and compliance staff responsible for audits, regulatory questions, and policy enforcement

When adopted, the policy guides day-to-day users and establishes escalation points for legal review, privacy incidents, and platform procurement decisions.

Essential Elements to Include in the Policy

A comprehensive policy combines practical rules, technical controls, and governance steps so teams can safely use AI in HR while meeting legal obligations.

Scope

Define covered systems, roles, and HR activities (recruiting, onboarding, benefits administration) so users know when the policy applies and when it does not.

Allowed Uses

List approved use cases (e.g., summarizing resumes, drafting standard communications) and specify any required human review before final decisions.

Prohibited Uses

Prohibit sending protected personal data, unredacted PHI, or legally sensitive information to public AI services without a BAA or equivalent controls.

Data Handling

Prescribe classification, redaction, retention, and logging for outputs and prompts; require minimum authentication and access controls.

Escalation & Review

Establish when to consult legal or privacy teams for adverse actions, discrimination risk, or unusual data exposures.

Training & Monitoring

Require user training, periodic audits, and metrics for misuse, accuracy, and governance effectiveness.

Step-by-Step: Adopting and Activating the Policy

  • 01
Draft and Align: Draft with HR, legal, and IT input.
  • 02
Risk Review: Assess data, privacy, and discrimination risks.
  • 03
Approval: Obtain executive or legal sign-off.
  • 04

  • Legal Review: Final signed copy routed to legal for retention and audit use.
  • Employee Acknowledgment: Distribute for employee signature and store acknowledgements centrally.
  • External Audit: Provide controlled access to auditors and regulators as required.

Digital Signing, Storage, and Integration Requirements

Specify required technical controls for any e-signature or document platform used to publish and acknowledge the policy.

  • Encryption: TLS 1.2/1.3 in transit; AES-256 at rest.
  • Authentication: Multi-factor for administrators.
  • Integrations: Connects with HRIS and document storage.

Key Legal and Operational Risks

Data Breach: Regulatory fines and breach notices.
HIPAA Exposure: HIPAA liability (45 CFR §164.530(j)).
I-9 Violations: I-9 penalties (8 CFR §274a.2).
Discrimination Claims: EEOC risk from biased outputs.
Contract Liability: Vendor contract breaches and indemnity.
Reputational Harm: Loss of trust with employees.

Common Mistakes to Avoid When Preparing the Policy

  • Drafting vague scope language that fails to specify which HR processes and tools are covered, causing inconsistent enforcement and confusion among managers.
  • Permitting unrestricted use of public AI services with unredacted employee data, which can lead to unauthorized disclosures and regulatory violations.
  • Failing to require human review for high-stakes decisions, leaving the employer exposed to discrimination claims or poor operational outcomes.
  • Neglecting to update the policy when tools or vendor contracts change, resulting in mismatches between actual practice and documented controls.

Practical Tips for Accurate and Efficient Policy Use

Adopt operational habits that reduce friction and increase compliance when teams use AI for HR tasks.

Redact Before You Ask
Remove or mask personal identifiers, protected health information, and salary details before submitting prompts to any external AI service to limit exposure and maintain privacy.
Use Approved Prompts
Provide a library of vetted prompts and templates for common tasks so users get consistent outputs and avoid ad hoc, risky queries.
Require Human Sign-Off
For candidate selection, disciplinary action, or benefits denials, always require a named HR reviewer to confirm AI-derived recommendations in writing.
Log and Audit
Maintain automated logs of prompts, outputs, and reviewers for at least the retention period required by applicable regulations.
