HR CLAIMS PROCEDURE

Purpose and Scope

This procedure establishes the internal process for reporting, investigating, and resolving employee claims including but not limited to allegations of harassment, discrimination, wage and hour disputes, workplace safety concerns, retaliation, and other employment-related complaints. It applies to all employees, contractors, and applicants of the organization.

Definitions

For purposes of this procedure, "complainant" means the person raising a claim, "respondent" means the person against whom a claim is made, and "investigator" means an individual designated by Human Resources to conduct fact-finding.

Investigation Process

Upon receipt of a claim, Human Resources will: (a) acknowledge receipt in writing within five business days; (b) conduct a prompt and impartial investigation; (c) provide the parties with a summary of findings and any remedies determined; and (d) retain investigation records for the period required by company policy.

Investigations will ordinarily be completed within thirty business days from the date of acknowledgment. Timeframes may be extended for cause; extensions and reasons will be documented and communicated to the parties.

Interim Measures and Remedies

Remedies following investigation may include disciplinary action up to termination, training, corrective action, and appropriate remedial measures.

What the HR Claims Procedure Is and When It Applies

The HR Claims Procedure is an internal process and associated document set used to receive, record, investigate, and resolve employee claims such as workplace injuries, discrimination, harassment, benefits disputes, and wage complaints. It defines submission channels, required information, timelines, responsibility for investigation, documentation standards, confidentiality rules, and record retention. In the United States this procedure should be designed to align with federal and state laws (including ESIGN/UETA for e-submissions and HIPAA when protected health information is involved) and to create a clear audit trail for compliance and dispute resolution.

Why a Clear HR Claims Procedure Matters

A documented HR claims procedure ensures consistent intake, protects confidentiality, speeds resolution, and reduces legal and operational risk. Using a secure electronic workflow preserves an audit trail, enforces deadlines, and helps demonstrate compliance with ESIGN/UETA and industry-specific rules such as HIPAA.

Why a Clear HR Claims Procedure Matters

Who Uses and Completes the HR Claims Procedure

This procedure is used by multiple stakeholders within and outside HR who participate in claim intake, review, or resolution.

  • HR managers and specialists responsible for intake, triage, and recordkeeping.
  • Employees or former employees submitting claims, and their authorized representatives.
  • Legal, compliance, and line managers who investigate, approve remedies, or escalate issues.

Clear role definitions reduce handoff delays and ensure the right people receive notice and documentation.

Step-by-Step: Submitting and Processing a Claim

Follow these core steps to ensure timely, auditable handling of each HR claim.

  • 01
Initiate Claim: Submit the completed form and attachments to HR intake.
  • 02
Assign Reviewer: HR assigns a case owner and notifies relevant managers.
  • 03
Investigate: Collect statements, evidence, and interview witnesses.
  • 04
Resolve & Close: Document outcome, actions taken, and retention location.

Configuring an Online HR Claims Workflow

Typical configuration settings ensure consistent routing, notifications, and access controls in a digital workflow.

Field Configuration
Routing Order Sequential HR → Manager → Legal
Notifications Email + SMS for critical updates
Authentication Email link, SMS OTP, or stronger MFA
Conditional Fields Show injury questions only when applicable

Where to File, Send, and Store Completed Claims

Claims can be submitted and routed electronically; ensure each destination supports secure storage and an audit trail.

  • Submit to HR Portal: Employee uploads form and attachments into portal.
  • Route to Manager: Automatic routing based on department or location.
  • Legal/Compliance Review: Selected cases escalate for legal review and redaction.
  • Archive Securely: Store final records in encrypted, access-controlled archive.

Technical Requirements for Digital Submission and eSigning

Choose platforms that support required file formats, integrations, and signer authentication methods.

  • Integrations: Salesforce, NetSuite, Microsoft 365
  • File Formats: PDF, DOCX, and image uploads
  • Authentication: Email link, SMS OTP, SSO

Ensure the chosen platform offers audit trails, encryption (TLS/AES), and the ability to apply conditional fields and retention policies to meet compliance needs.
