Qualifying Event

Select the qualifying event that entitles the Qualified Beneficiary to elect continuation coverage:

Date of Qualifying Event:     Date Coverage Terminated:

COBRA Coverage Options & Premiums

Available coverage options under the plan and monthly premium amounts are listed below. Premiums are payable by the Qualified Beneficiary when COBRA is elected. The initial premium deadline and monthly due dates will be specified by the Plan Administrator.

Important: Qualified Beneficiaries generally have 60 days to elect continuation coverage measured from the later of the date of this notice or the date coverage would otherwise end. If elected, premiums may include a reasonable administrative charge (commonly up to 102% of the applicable premium) and premiums are retroactive to the date coverage was lost. The initial premium payment deadline following an election may be shorter; the Plan Administrator will provide the exact payment deadline. Subsequent premiums are due on a monthly schedule and may include a permitted grace period.

Election To Continue Coverage

Check one option below and sign to elect continuation coverage. If electing, indicate payment method and provide required payment information.

Termination of Continuation Coverage

Continuation coverage may be terminated earlier than the maximum coverage period for reasons including: nonpayment of required premiums, termination of the employer's plan, a Qualified Beneficiary's entitlement to Medicare after electing COBRA, or fraud or misrepresentation in connection with coverage. The Plan Administrator will notify you of termination reasons and applicable deadlines.

Appeals, Disputes, and Notices

If you dispute a determination regarding eligibility or premiums, submit a written appeal to the Plan Administrator at the address listed above. The Plan Administrator will review appeals in accordance with plan procedures and will provide written notice of any adverse determination with the reasons and any appeal rights.

What the HR COBRA Rights Document Is and when it’s used

An HR COBRA Rights Document explains federal continuation-of-coverage options under COBRA (Consolidated Omnibus Budget Reconciliation Act) to employees and their qualified beneficiaries after a qualifying event. It combines the mandatory election notice, details about available coverage, premium responsibility, timelines for election and payment, and contact information for the plan administrator. Employers and plan administrators issue this document to ensure beneficiaries understand their rights to continue group health coverage, the practical steps to elect coverage, and any deadlines that affect eligibility or reinstatement.

Why a clear COBRA Rights Document matters

A precise HR COBRA Rights Document reduces compliance risk, preserves employees’ coverage options, and documents notice delivery for audit trails and potential regulatory review.

Why a clear COBRA Rights Document matters

Who prepares, distributes, and receives this document

Proper role assignment and documented distribution help demonstrate compliance and make it easier for beneficiaries to act within required timeframes.

  • HR or benefits administrators responsible for compliance and enrollment processing, often at the company or third-party administrator.
  • Plan administrators and payroll teams that track eligibility, premium collection, and coverage dates for continuing coverage.
  • Employees and qualified beneficiaries who may elect COBRA continuation following a qualifying event, such as termination or loss of dependent status.

Representative signers and stakeholders

HR Benefits Manager

A benefits manager typically prepares the COBRA Rights Document, verifies plan data, confirms qualifying events, and maintains delivery records. They coordinate with the plan administrator and payroll to ensure accurate premium amounts and timelines are communicated.

Qualified Beneficiary

An employee or dependent who receives the notice. The beneficiary must review coverage options, decide whether to elect continuation, and comply with payment deadlines. Clear contact details and election instructions reduce confusion and missed elections.

Step-by-step: completing a HR COBRA Rights Document

Follow this sequence to prepare and deliver a compliant COBRA Rights Document to eligible recipients.

  • 01
Confirm eligibility: Verify qualifying event and eligible beneficiaries.
  • 02
Populate notice: Enter plan, premium, and coverage details accurately.
  • 03
Deliver notice: Send via the plan’s approved delivery method promptly.
  • 04
Record delivery: Log date, method, and recipient for audit trail.

Essential elements to include in a professional COBRA Rights Document

A complete document contains legal notice language, actionable election steps, clear premium details, and recordkeeping information for both the beneficiary and plan.

Mandatory notice

Standard election language explaining continuation rights, conditions for coverage, and beneficiary responsibilities in clear, non-technical terms.

Coverage options

Explicitly list which plan options continue, covered dependents, any changes to benefits, and whether alternative plans are available.

Election instructions

Stepwise instructions for electing coverage, including where to sign, return addresses, accepted electronic methods, and required documentation.

Premium terms

Current premium amount, any allowable administrative surcharge, payment due dates, and consequences of late or missed payments.

Important deadlines

Clear statement of election and payment deadlines, how they are calculated, and examples to reduce recipient confusion.

Recordkeeping notes

Who retains proof of delivery, how long records are kept, and contact points for disputes or questions.

How delivery and election typically flow

A reliable distribution and response process reduces missed elections and supports accurate audit records.

  • Prepare notice: Generate notice populated with beneficiary and plan data.
  • Send notice: Deliver via mail, email, or secure portal per plan rules.
  • Beneficiary elects: Recipient signs and returns form or completes online election.
  • Document and confirm: Log receipt, update coverage status, and send confirmation.

Configuring digital workflows for COBRA notice delivery

Use a controlled workflow that captures delivery, signer authentication, and a tamper-evident audit trail for each notice.

Field Configuration
Delivery Method Mail, secure email, or encrypted portal — record method used.
Authentication Use email link, SMS code, or multi-factor where required.
Signature Capture Enable typed, drawn, or PKI-backed signatures depending on sensitivity.
Retention Store signed copy and audit trail in compliant archive.

Technical considerations for electronic delivery and signing

Ensure chosen tools meet applicable compliance needs (HIPAA if PHI is included) and preserve an immutable audit trail.

  • Document formats: PDF and DOCX support for fillable forms and locked final copies.
  • Integrations: Connectors to HRIS, payroll, and benefits platforms reduce manual errors.
  • Authentication options: Email, SMS, ID verification, or enterprise SSO for stronger signer identity.

Common deadlines and timing to include in the notice

Make deadlines explicit — beneficiaries frequently miss election or payment cutoffs when dates or counting rules are unclear.

Election period:

60 calendar days to elect continuation coverage from the date allowed to elect.

Notice to administrator:

Notify plan administrator promptly, typically within 30 days of certain qualifying events.

Initial premium payment:

Initial premium often due within 45 days after electing coverage.

Ongoing premium grace:

Monthly premium grace periods commonly 30 days for subsequent payments.

Coverage retroactivity:

Coverage usually retroactive to the date of loss if timely elected and paid.

Key milestone timeline for handling a qualifying event

Sequence major milestones so administrators and beneficiaries can track required actions and evidence of delivery.

01

Event Occurs

Document the qualifying event date and affected participants.

02

Administrator Notified

Plan receives employer or participant notice and starts processing.

03

Election Notice Sent

Provide the COBRA Rights Document to beneficiaries with election instructions.

04

Election & Payment

Beneficiary returns election and arranges initial premium payment.

Common preparation and delivery mistakes to avoid

  • Using inconsistent beneficiary names across records, which delays enrollment and may trigger additional verification steps.
  • Omitting clear payment instructions or acceptable methods, causing missed payments and coverage lapses.
  • Failing to record delivery date and method, leaving the employer exposed in compliance reviews or disputes.
  • Relying solely on ambiguous language about deadlines rather than giving explicit MM/DD/YYYY dates and counting rules.

Consequences of incomplete or incorrect COBRA notices

Loss of coverage: Qualified beneficiaries may lose the opportunity to continue coverage.
Regulatory exposure: Plan sponsors face regulatory inquiries and corrective action requirements.
Administrative costs: Errors increase administrative burden and remediation expenses.
Disputes and appeals: Inaccurate notices lead to beneficiary disputes and potential legal claims.
Reputational risk: Poor handling undermines trust with employees and beneficiaries.
Recordkeeping gaps: Missing delivery logs complicate audits and defense against claims.

Security and compliance controls to protect notice delivery and records

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit trail: Timestamped logs with signer attribution
HIPAA-ready: Supports HIPAA compliance with a required BAA
ESIGN / UETA: Electronic signatures valid under ESIGN and UETA
Certifications: SOC 2 Type II and ISO 27001 available
Accessibility: WCAG 2.0 Level AA conformance options
