HR Discrimination Policy

Effective Date:

Purpose and Scope

This policy sets forth the Company's commitment to a workplace free from unlawful discrimination and harassment. It applies to all employees, applicants for employment, contractors, interns, and volunteers in all locations and in all employment-related activities, including recruitment, hiring, promotion, compensation, benefits, training, and termination.

Policy Statement

The Company prohibits discrimination or harassment on the basis of race, color, religion, sex, sexual orientation, gender identity or expression, national origin, ancestry, citizenship status, age, disability, genetic information, marital status, veteran status, or any other characteristic protected by applicable law. Employment decisions will be based on legitimate, non-discriminatory business reasons.

Definitions

For purposes of this policy, "discrimination" means adverse action taken because of a protected characteristic. "Harassment" includes unwelcome conduct that is severe or pervasive enough to create an intimidating, hostile, or offensive work environment or results in adverse employment action.

Reporting Procedure

Employees who believe they have been subjected to discrimination or harassment must report the conduct promptly to their manager or Human Resources. Reports may be made orally or in writing. The Company will investigate all reports promptly, thoroughly, and impartially.

Investigation Process

The Company will assign an investigator and, where appropriate, interview the complainant, alleged victim, witnesses, and the alleged harasser. Confidentiality will be maintained to the extent possible. Interim measures to protect complainants may be implemented pending investigation.

Retaliation Prohibited

Retaliation against anyone who reports discrimination or participates in an investigation is strictly prohibited. Any retaliatory action will result in disciplinary measures up to and including termination.

Reasonable Accommodation

The Company will engage in an interactive process to provide reasonable accommodation to qualified individuals with disabilities and to otherwise comply with applicable law related to religious accommodations.

Training and Distribution

The Company provides periodic training on non-discrimination and harassment prevention. This policy will be provided to all employees and made available upon request.

Enforcement and Discipline

Violations of this policy will result in corrective action, up to and including termination. Determinations will be made based on the facts obtained during the investigation and in accordance with applicable policies and law.

What an HR Discrimination Policy Covers

An HR Discrimination Policy is a written employer document that defines prohibited discriminatory conduct, identifies protected characteristics, sets out complaint and investigation procedures, and describes remedies and non-retaliation protections. It applies to recruitment, hiring, promotion, discipline, termination, training, benefits, and workplace conduct. The policy clarifies employee rights, manager responsibilities, reporting channels, and timelines for internal handling and recordkeeping to ensure consistent responses to alleged discrimination.

Why a Clear Policy Matters for Employers

A formal policy reduces legal risk, promotes consistent decision-making, supports a respectful workplace, and documents steps taken to prevent and address discrimination.

Why a Clear Policy Matters for Employers

Who Drafts, Reviews, and Relies on This Policy

The HR team typically drafts the policy; legal counsel and operations leaders review and approve it before organization-wide distribution.

  • Human resources and legal teams responsible for compliance and training.
  • Managers and supervisors who must enforce rules and report incidents.
  • All employees who receive training and may follow internal reporting steps.

Regular review by HR and legal keeps the policy aligned with federal and state law and current workplace practices.

Essential Sections to Include in a Professional Policy

A complete policy is concise yet comprehensive, covering definitions, protected classes, reporting and investigation procedures, anti-retaliation language, disciplinary measures, and training expectations.

Definitions

Clear definitions of discrimination, harassment, and related conduct to remove ambiguity and guide investigations.

Protected Classes

List federal and applicable state protected characteristics, plus any additional company-specific protections.

Reporting Channels

Multiple reporting options (supervisor, HR, ethics hotline) with confidentiality exceptions stated.

Investigation Process

Steps, expected timelines, investigator neutrality, and interim measures to protect parties during review.

Corrective Action

Range of disciplinary outcomes, documentation standards, and measures to prevent recurrence.

Non-Retaliation

Explicit prohibition on retaliation and remedies for adverse actions against reporters or witnesses.

How Reporting and Investigation Flow Works

A standardized workflow helps preserve evidence, maintain impartiality, and meet internal and external deadlines.

  • Report Received: HR logs complaint and informs parties of process.
  • Preliminary Assessment: Determine severity and need for interim measures.
  • Investigation: Collect evidence, interview witnesses, and document findings.
  • Resolution: Apply corrective actions and communicate outcomes appropriately.

Digital Options for Policy Distribution and Acknowledgment

Use secure delivery and e-signature to distribute policies and capture employee acknowledgments efficiently.

Common Mistakes When Preparing an HR Discrimination Policy

  • Vague reporting instructions that leave employees unsure how or where to file complaints, delaying responses and increasing liability.
  • Unrealistic investigation timelines that are not met, undermining confidence and potentially leading to claims of inaction or bias.
  • Inconsistent enforcement across departments where similar misconduct receives different discipline, exposing the employer to discrimination claims.
  • Poor recordkeeping and lost investigation notes, which weaken the employer's position during administrative or court proceedings.
