What an HR Marketing Contract Covers

An HR Marketing Contract is a written agreement between an employer or human resources provider and a marketing consultant or agency that defines services, deliverables, timelines, compensation, intellectual property assignment, confidentiality, and performance metrics related to employer branding, recruitment marketing, or candidate outreach campaigns. The contract clarifies who provides marketing assets, how candidate data will be handled, which parties own creative work, and required compliance measures for employee privacy laws. When used with an eSignature platform, the contract can be executed digitally under U.S. e‑signature laws such as ESIGN and state UETA statutes.

Why a Clear HR Marketing Contract Matters

Use an HR Marketing Contract to set clear expectations, allocate IP rights, and document data handling for candidate communications. It reduces disputes, documents consideration, and supports regulatory compliance with ESIGN and privacy requirements when executed electronically.

Why a Clear HR Marketing Contract Matters

Who Typically Uses This Contract

Typical users include HR managers, recruitment marketing teams, external agencies, and in-house recruiters who coordinate employer branding and candidate outreach campaigns.

  • HR managers coordinating employer branding and candidate attraction campaigns across channels.
  • Recruitment marketing agencies delivering creative assets, campaign strategy, and reporting.
  • In-house recruiters managing candidate outreach, consent for data use, and social advertising.

Use the contract when outsourcing recruitment marketing or when collecting candidate data to ensure responsibilities and liabilities are clearly assigned.

Essential Sections to Include in the Contract

Core sections that make an HR Marketing Contract enforceable and usable across teams: defined services, payment terms, IP assignment, data handling, confidentiality, and termination rights.
