What the HR Marketing Manager Agreement Is and When It’s Used

The HR Marketing Manager Agreement is a written contract that sets the terms between an employer and a marketing manager responsible for employer branding, recruitment marketing, and internal communications. It typically covers duties, compensation, performance metrics, confidentiality, intellectual property assignment, non-compete or non-solicit clauses where permitted, and termination terms. This agreement formalizes expectations for recruitment campaigns, candidate outreach, and collaboration with HR, legal, and external agencies. Parties may sign the agreement electronically under U.S. e-signature laws when the transaction is eligible for electronic execution.

Why Use a Dedicated HR Marketing Manager Agreement

A tailored HR Marketing Manager Agreement reduces ambiguity about responsibilities and IP ownership, aligns marketing deliverables with HR priorities, and documents compensation and performance terms in a legally enforceable format under ESIGN and UETA.

Why Use a Dedicated HR Marketing Manager Agreement

Who Typically Prepares and Signs This Agreement

Use role-based review—HR for operational terms, legal for enforceability, and the hiring manager for scope and metrics—to reduce later disputes.

  • Hiring manager or HR generalist: prepares role requirements and performance metrics.
  • Legal or employment counsel: reviews IP, non-compete, and compliance language.
  • Candidate or contractor: signs to accept terms and deliverables.

Representative Signatories and Their Roles

HR Business Partner

Drafts and approves compensation and benefits sections, confirms compliance with company policy, and coordinates onboarding checkpoints tied to the agreement.

Marketing Hiring Manager

Defines scope, objectives, deliverables, and reporting relationships; evaluates performance under the agreement and authorizes role-specific budgets.

Essential Sections to Include in the Agreement

A complete HR Marketing Manager Agreement balances operational clarity with legal protection. The following six elements form the core structure you should include and review with appropriate stakeholders.

Scope of Work

Describe duties (recruitment marketing, employer brand campaigns, analytics), deliverables, KPIs, reporting cadence, and any project-based assignments.

Compensation

State salary, bonus structure, commission or performance incentives, payment timing, and reimbursement of preapproved expenses.

Intellectual Property

Assign ownership for campaign assets, creative work, and content; specify work-for-hire language and any licensing back to the employee or contractor.

Confidentiality

Narrowly define confidential information, duration of nondisclosure obligations, and permitted disclosures for legal or compliance reasons.

Term & Termination

Set the agreement term, notice periods, cause vs. without-cause termination, and post-termination obligations such as return of materials.

Compliance & Policies

Reference company policies, data-protection obligations, background-check contingencies, and governing law for dispute resolution.

Step-by-Step: Filling Out and Finalizing the Agreement

Complete the form in logical order, confirm legal language with counsel, then execute signatures in the prescribed order.

  • 01
Draft: Populate role, scope, and compensation fields first.
  • 02
Review: Have HR and legal review IP and termination clauses.
  • 03
Authorize: Obtain internal approval from finance and hiring manager.
  • 04
Sign: Execute electronically or in-person following authentication rules.

Where to Send and How the Signed Agreement Is Processed

Understand routing and final storage so the agreement becomes actionable for payroll, IT access, and onboarding.

  • Upload: Add the final PDF to HRIS or contract repository.
  • Notify: Email copies to payroll, IT, and the hiring manager.
  • Onboard: Trigger IT access and benefits enrollment after signatures.
  • Archive: Store the executed file in the secured records system.

Standard Online Workflow Configuration for Electronic Completion

Configure e-signature workflows to enforce sign order, authentication, and destination routing for downstream systems.

  • Document Formats: PDF, DOCX accepted by most platforms
  • Integrations: Connectors for HRIS, Google Workspace, and Microsoft 365
  • Authentication: Email, SMS, or advanced signer verification

Key Time-Sensitive Actions and Typical Deadlines
