What the HR Post-Production Agreement Is

The HR Post-Production Agreement is a written contract that sets terms between an employer or production company and post-production personnel or vendors. It defines role descriptions, deliverables, schedules, compensation, intellectual property assignment, confidentiality obligations, warranties, and dispute resolution. The document also addresses onboarding requirements such as tax classification, I-9 completion, insurance, and benefits enrollment. When executed electronically, it can meet U.S. legal standards for e-signatures under the ESIGN Act and state UETA statutes, provided intent, consent, attribution, and retention requirements are satisfied.

Why a Formal Agreement Matters

A clear HR Post-Production Agreement reduces role ambiguity, protects IP and confidential material, establishes payment and schedule expectations, and documents compliance with employment and tax rules. It also creates an evidentiary record that supports dispute resolution and regulatory audits when properly executed and retained.

Why a Formal Agreement Matters

Who Uses This Agreement

Typical users complete this agreement during hiring or vendor onboarding for post-production services.

  • Production companies managing editors, colorists, or VFX teams during project onboarding and vendor contracting.
  • HR teams documenting worker classification, payroll setup, benefits eligibility, and I-9 verification for new hires.
  • Freelance post-production professionals who need clear payment terms, IP assignment, and confidentiality protections.

Use this form to centralize administrative, legal, and payroll-related requirements for post-production roles.

Common Preparation Mistakes to Avoid

  • Using vague scope language that leaves deliverables and acceptance criteria undefined, leading to disputes over completed work and payment.
  • Failing to assign intellectual property clearly, which creates ownership uncertainty for final media and can halt distribution or monetization.
  • Omitting tax and classification details for contractors versus employees, triggering payroll corrections or backup withholding obligations.
  • Neglecting to include confidentiality or data handling provisions when work involves sensitive footage or personal data.

Penalties and Key Legal Risks

I-9 Penalties: $281–$2,789 per violation
Misclassification: Wage and tax liabilities possible
Overtime Liability: FLSA exposure for exempt misclassification
Tax Withholding: Backup withholding 24% if incorrect TIN
IP Disputes: Loss of exclusive rights risk
Contract Breach: Damages and injunctions possible

Where to File, Send, or Submit the Agreement

After execution, route copies to payroll, HR personnel file systems, and relevant vendors; ensure archival and access controls are applied.

  • HR Record: Store signed copy in centralized personnel file.
  • Payroll System: Provide compensation details for setup.
  • Benefits Vendor: Send enrollment data when applicable.
  • Legal Archive: Retain executed agreement for compliance.

Who Can Sign on Behalf of an Organization

Authorized Signatory

A named officer, director, or manager with written delegation or board resolution. Ensure documentation of signing authority is available in the corporate record to avoid enforceability challenges.

HR Director

HR director or designee may sign for employment terms where corporate policy delegates authority; procurement thresholds may still require higher-level approval.

Real-world Use Cases

These concise examples show typical ways the agreement is used across organizations and projects.
