LEAD FROM PAINT, DUST, AND SOIL CAN BE DANGEROUS IF NOT MANAGED PROPERLY Disclosure of Information on Lead-Based Paint and/or Lead-Based Paint Hazards Lead Warning Statement Every purchaser of any interest in residential real property on which a residential dwelling was built prior to 1978 is notified that such property may present exposure to lead from lead-based paint that may place young children at risk of developing lead poisoning. Lead poisoning in young children may produce permanent neurological damage, including learning disabilities, reduced intelligence quotient, behavioral problems, and impaired memory. Lead poisoning also poses a particular risk to pregnant women. The Seller of any interest in residential real property is required to provide the buyer with any information on lead-based paint hazards from risk assessments or inspections in the Seller's possession and notify the buyer of any known lead-based paint hazards. A risk assessment or inspection for possible lead-based paint hazards is recommended prior to purchase. (ii) seller, prior to making a sale of the housing, does an inspection to determine the potential risk of lead contamination of the interior of the housing or to identify possible locations for paint abatement or lead hazard abatement activities. The seller must complete a risk assessment or inspection in accordance with the provisions in part 1, section of the florida statutes. (c) the seller also complies with the requirements of section of the florida statutes as follows: (i) seller and purchaser of the housing complete a risk assessment or inspection in accordance with the provisions of section of the florida statutes as follows: (2) (b) any person or agency who has knowledge and reasonable cause to believe that a dwelling has been or is being used in a manner which could result in such dwelling's being filled with lead or is being used or could cause such dwelling to be filled with lead is hereby notified as soon as possible to the seller of the dwelling or, failing a sale, when making such notification, to the purchaser. The person or agency must present the notice within 24 hours of first being notified. The notice must contain such information as the department of health and the seller must furnish to the purchaser of the information presented. Within 48 hours of receiving the notice, the seller must take the necessary action. (c) within 10 days from the date of the notice, the purchaser must complete a risk assessment or inspection, the risk assessment or inspection must include: (i) a statement of all known lead-based paint and lead-based paint hazards (explain) (ii) a copy of the completed risk assessment or inspection or notification (explain), and (iii) a statement from the purchaser that all the information furnished in the risk assessment or inspection has been furnished to the seller. The purchaser is responsible for conducting a test to determine the presence of lead. This test must be conducted by a licensed private laboratory that is certified to have obtained results from the most current methods and for compliance with all state and federal requirements. Failure to perform the test in accordance with this part will void the results given by the laboratory and the notification required under (b)(3) above. (d) seller and purchaser of the dwelling or, failing a sale, when making such notification, must do both actions in accordance with this section within 48 hours of receiving the notice.
