INSTRUCTOR EMPLOYMENT CONTRACT

This Instructor Employment Contract (the "Contract") is entered into on this day of , by and between Employer Name: (the "Employer"), and Instructor Name: .

1. Appointment and Term

1.1 Appointment: Employer hereby employs Instructor as in the . Instructor accepts such appointment and agrees to perform the duties set forth in Section 2.

Instructor performance will be reviewed on a basis according to criteria including teaching effectiveness, contributions to curriculum, service to the program, and engagement in professional development. Evaluation procedures shall follow Employer policies.

6. Leave, Holidays and Absences

Instructor must request leaves in accordance with Employer policy. Employer may require documentation for extended absences. Unscheduled absences that materially interfere with instructional obligations may be treated as grounds for discipline or termination.

7. Intellectual Property, Course Materials and Scholarly Work

7.1 Work Product: All works, course materials, curriculum design, assessments, software, and other materials created by Instructor in the scope of employment (collectively, "Work Product") shall be considered works made for hire and are the exclusive property of Employer. To the extent ownership is not automatic, Instructor hereby assigns all right, title, and interest to Employer.

7.2 Exceptions: Pre-existing materials and scholarly works created independent of Employer duties are retained by Instructor provided they are disclosed in writing prior to disclosure or use for Employer purposes.

8. Confidentiality and Student Records

Instructor shall not disclose confidential information acquired in the course of employment, including student records and proprietary institutional information, except as required by law or permitted by Employer policy. This obligation survives termination of employment.

9. Conflict of Interest and Outside Employment

Instructor agrees to disclose any outside employment or activities that create a conflict of interest and to obtain written approval from the Department Chair prior to engaging in compensated external teaching or consulting that materially interferes with duties hereunder.

10. Termination

10.1 For Cause: Employer may terminate this Contract for cause for material breach, professional misconduct, failure to perform duties, or violation of policy. Cause termination may be immediate and without notice.

10.2 Without Cause: Employer may terminate without cause upon notice, subject to any statutory obligations or contractual severance provisions.

10.3 Suspension: Employer may place Instructor on administrative leave pending investigation of alleged serious misconduct.

11. Background Checks and Compliance

Employment is conditioned on satisfactory completion of background checks, reference checks, and any health or screening requirements required by Employer. Instructor must comply with all applicable Employer policies, handbooks, and codes of conduct.

12. Notices

Notices under this Contract shall be sent to the addresses below. Notices are effective upon delivery by hand, courier, or postal service.

13. Governing Law, Dispute Resolution and Miscellaneous

This Contract shall be governed by the laws of the state indicated in the Employer's principal address. Any dispute arising out of or related to this Contract shall be resolved by the courts of that state, unless the parties agree in writing to alternative dispute resolution.

This Contract constitutes the entire agreement between the parties and supersedes all prior representations, understandings, and agreements. No amendment shall be effective unless in writing and signed by both parties.
