What the Hawaii General Warranty Deed Is

The Hawaii General Warranty Deed is a formal conveyance instrument used to transfer real property in Hawaii where the grantor provides broad warranties of title to the grantee. It typically contains covenants of seisin, the right to convey, freedom from encumbrances, quiet enjoyment, and warranty of title, and is executed by the seller, acknowledged by a notary, and recorded with the Hawaii Bureau of Conveyances to give public notice and protect the grantee's ownership rights.

Why a General Warranty Deed Matters for Buyers and Sellers

A General Warranty Deed supplies the highest level of assurance that the grantor holds and will defend title; it protects buyers from prior title defects and provides a clearer route to title insurance and legal remedies if problems arise.

Why a General Warranty Deed Matters for Buyers and Sellers

Who Prepares and Relies on This Deed

Typical users who prepare or rely on the Hawaii General Warranty Deed include real estate attorneys, title companies, lenders, and buyers or sellers.

  • Title companies verifying chain of title, issuing title insurance, and preparing recording documents.
  • Buyers and lenders requiring full warranty protections before loan funding or closing.

Core Elements to Include in a Professional Hawaii General Warranty Deed

Essential elements of a professional Hawaii General Warranty Deed ensure clear conveyance, enforceable covenants, proper notarization, accurate legal descriptions, and recording instructions tailored for Hawaii's Bureau of Conveyances.

Grantor & Grantee

Identify grantor and grantee using full legal names and business entity forms; include title or capacity for signing parties to prevent ambiguity and ensure the deed binds the correct legal persons.

Legal Description

Insert the property’s complete metes-and-bounds or tax map parcel description exactly as recorded; do not substitute street addresses, which are insufficient for recording and may cause title defects.

Consideration

State the consideration amount or a lawful recital of consideration; include monetary value or a nominal phrase and avoid vague expressions to prevent challenges under Hawaii conveyancing law.

Warranties

Include standard general warranty covenants—seisin, right to convey, against encumbrances, quiet enjoyment, and warranty of title—ensuring the grantor defends title from prior claims and compensates for losses.

Notary Acknowledgment

Provide a Hawaii-compliant notary acknowledgment block with the notary's signature, seal, and county of acknowledgment; notarization is required before recording at the Bureau of Conveyances.

Recording Instructions

Include grantor contact, return address, and sender information; state preferred documentary fee classification and indicate whether mailed or held for pickup to streamline Hawaii Bureau processing.

Timing Considerations That Affect Validity and Priority

Key timing points affect validity, recording priority, and tax or title consequences when using a Hawaii General Warranty Deed.

Execution and Notarization Deadline:

Execute prior to closing and notarize the same day when possible to avoid delays.

Recording to Preserve Priority:

Record promptly; recorded deed beats later unrecorded claims and preserves lender priorities.

Tax Document Reporting Windows:

Transfer may trigger reporting or documentary tax forms; consult county and IRS rules.

RON Session Retention:

If RON used, retain audio-video recording per state notary rules.

Title Insurance Issuance Timing:

Title companies issue policies after recording and lien search updates; timing varies by underwriter.

Common Preparation Errors to Avoid

  • Using a street address instead of an exact legal description can result in rejection by the Bureau of Conveyances and create insurable title gaps.
  • Failing to include the grantor's capacity or corporate authority may invalidate conveyance when the signer lacks apparent authority.
  • Omitting a required notary acknowledgment or using the wrong notary county leads to recording delays and possible refunds of documentary fees.
  • Submitting the deed without attaching required exhibits, surveys, or documentary stamps can cause rejection and increase processing time.

Consequences of Incorrect or Incomplete Deeds

Recording Rejection: Deed returned; delays recording.
Title Insurance Risk: Coverage exceptions may be added.
Tax Liability: Potential documentary taxes apply.
Legal Challenges: Prior claims may lead to litigation.
Penalties: County fines or re-filing fees.
RON Noncompliance: State rules may void notarization.
