What a Marketing Internship Agreement Covers

A Marketing Internship Agreement is a written contract that sets the terms between an organization and an intern engaged in marketing-related work. It defines scope of duties, duration, supervision, compensation (if any), confidentiality and intellectual property assignment, compliance expectations, and termination conditions. The agreement clarifies whether the intern is unpaid, paid, or receiving academic credit, and documents onboarding steps such as I-9 and tax form requirements. Clear written terms reduce disputes and support consistent onboarding and recordkeeping practices.

Why a Written Agreement Matters for Internships

A written Marketing Internship Agreement creates predictable expectations for both parties, protects intellectual property, and documents classification and compensation choices for regulatory review.

Why a Written Agreement Matters for Internships

Who Typically Uses the Marketing Internship Agreement

The agreement is also used by interns to confirm role, schedule, and compensation before starting work.

  • HR managers and recruiters responsible for onboarding interns and maintaining compliance.
  • Marketing team leads who define duties, supervision, and performance expectations.
  • Higher-education career services coordinating credit-bearing internships and documentation.

Essential Elements to Include in a Professional Agreement

A complete Marketing Internship Agreement organizes legal, operational, and administrative details so both parties understand expectations and obligations.

Term

Specify start and end dates, weekly schedule, and whether the term is renewable or contingent on academic credit.

Duties

Describe primary responsibilities, reporting structure, performance metrics, and required deliverables or learning objectives.

Compensation

State hourly rate, stipend, or unpaid status, including reimbursement policies and payment schedule if applicable.

Confidentiality

Define confidential information, nondisclosure obligations, duration of confidentiality, and permitted disclosures.

IP Assignment

Common Preparation Mistakes to Avoid

  • Failing to define duties clearly, which can create disputes over expected tasks or learning outcomes.
  • Omitting compensation terms or payment schedule, causing wage-and-hour classification uncertainty or payroll delays.
  • Not addressing intellectual property and ownership of intern-created work, risking loss of employer rights.
  • Using inconsistent names or dates that prevent verification or cause onboarding and tax-reporting errors.

Potential Consequences of an Incorrect Agreement

Wage Claims: Back pay and statutory penalties
Tax Exposure: IRS payroll tax liability
I-9 Violations: Civil fines per DHS rules
IP Loss: Employer may lack ownership
Regulatory Fines: HIPAA or FERPA fines if applicable
Contract Voidance: Courts may invalidate defective clauses
