What the Nanny Care Employment Agreement Is

A Nanny Care Employment Agreement is a written contract between a household employer and a nanny that records duties, schedule, compensation, benefits, termination terms, and confidentiality. It also allocates responsibilities for payroll taxes, workers' compensation, and background checks. Used across private households, agencies, and payroll services, the agreement clarifies expectations, reduces disputes, and documents consent for childcare and emergency decision-making. It can be executed electronically where permitted under federal and state e-signature laws such as the ESIGN Act and UETA.

Why a Clear Agreement Matters for Household Employment

A written nanny agreement sets rights and obligations, supports legal compliance with tax and employment rules, and reduces the risk of disputes by documenting pay, hours, duties, and notice periods.

Why a Clear Agreement Matters for Household Employment

Who Typically Uses This Agreement

Families hiring live-in or part-time nannies, placement agencies, and payroll services commonly rely on a formal agreement to document employment terms.

  • Private families hiring full-time or part-time childcare providers for routine household care and child supervision.
  • Nanny placement agencies that provide standard contract templates and placement terms for families and candidates.
  • Payroll services and household employers needing documentation for tax withholding, W-2 issuance, and benefits administration.

The document suits first-time household employers and experienced families who want consistent records for payroll, taxes, screening, and child-safety protocols.

Primary Parties and Typical Roles

Employer (Parent/Guardian)

The employer sets duties, schedule, pay, benefits, and payroll arrangements. They are responsible for legal obligations such as tax withholding, compliance with wage and hour rules, and providing a safe workplace for the caregiver.

Nanny / Caregiver

The nanny agrees to provide childcare services per the contract, follow safety protocols, maintain any certifications listed, and cooperate with background checks. The nanny’s signature confirms acceptance of compensation, hours, confidentiality, and termination provisions.

Core Sections to Include in a Professional Agreement

A comprehensive nanny agreement combines job details, pay and schedule, legal protections, and practical clauses so both parties have clear, enforceable expectations.
