What a Nanny Employment Agreement Covers

A Nanny Employment Agreement is a written contract that sets the working relationship between a household employer and an in-home caregiver. It documents duties, schedules, compensation, overtime, benefits, payroll and tax responsibilities, confidentiality, termination terms, and emergency procedures. A clear agreement reduces misunderstandings and supports accurate payroll and tax reporting. Electronic execution is generally valid under the federal ESIGN Act (15 U.S.C. ch. 96) and state UETA laws, subject to statutory exceptions and any applicable notary or state employment rules.

Why a Written Agreement Matters for Households

A written Nanny Employment Agreement clarifies expectations, documents pay and tax responsibilities, and reduces the risk of disputes or misclassification. It helps both parties comply with federal and state wage-and-hour rules and supports consistent payroll and benefits administration.

Why a Written Agreement Matters for Households

Who typically uses a Nanny Employment Agreement

Typical users include household employers, nanny candidates, and placement agencies seeking clear employment terms for consistent payroll and legal compliance.

  • Parents and household employers who hire in-home childcare and pay wages regularly.
  • Nannies or caregivers seeking written terms for schedule, pay, taxes, and termination.
  • Placement agencies and payroll providers managing contracts, background checks, and tax withholding.

Use the agreement before work begins and update it when duties, pay, or schedule change to maintain compliance and clarity.

Common mistakes to avoid

  • Failing to classify the worker correctly as an employee or independent contractor can trigger payroll tax, wage-and-hour, and unemployment insurance liabilities.
  • Omitting required tax forms (W-4, I-9) or inaccurate Social Security numbers can cause withholding errors and IRS penalties for employers.
  • Vague job descriptions lead to disputes over duties, extra hours, and off-duty responsibilities; be specific about tasks and boundaries.
  • Neglecting overtime, meal break, and state-specific domestic worker rules risks back-pay claims and statutory penalties from state labor agencies.
