What a Nurse Employment Agreement Covers

A Nurse Employment Agreement is a written contract that defines the working relationship between a healthcare employer and a nurse. It specifies role and duties, compensation, schedule, benefits, confidentiality, licensure and credentialing requirements, termination terms, and applicable workplace policies. The document can include HIPAA-related privacy obligations, noncompete or nondisclosure clauses where enforceable, and provisions about licensure maintenance. For electronic execution, the agreement may be signed under the ESIGN Act (15 U.S.C. ch. 96) or a state's UETA framework, provided no statutory exception applies.

Why a Clear, Executable Agreement Matters

A well-drafted Nurse Employment Agreement reduces disputes by setting expectations for duties, schedules, pay, credentialing, benefits, and termination procedures. It also documents compliance obligations such as HIPAA privacy rules and state nursing board requirements, and supports secure electronic execution under ESIGN (15 U.S.C. §7001) and UETA where applicable.

Why a Clear, Executable Agreement Matters

  • Hospital HR and Talent Acquisition teams responsible for hiring and credential verification.
  • Staffing and travel nurse agencies that place nurses under fixed-term contracts.
  • Individual nurses or nurse practitioners reviewing scope, pay, and mobility terms before accepting employment.

Each party should review responsibilities, licensure requirements, and any confidentiality or noncompetition language before signing.
