JOINDER TO UNIT OPERATING AGREEMENT AND/OR UNIT AGREEMENT THE _____ UNIT _____ COUNTY, _____ (By Royalty or Working Interest Owner) STATE: COUNTY: Each of the undersigned owners of royalty interests (whether one or more) acknowledges receipt of a counterpart of an instrument titled “Unit Agreement, _____ Unit, _____ County, _____” executed to be effective _____, by various persons, for conducting unit operations with respect to the _____ Field located in _____ County, _____. Each of the undersigned owners of a working interest (whether one or more) acknowledges receipt of a counterpart of the Unit Agreement, and a counterpart of an instrument titled “Unit Operating Agreement, _____ Uni t, _____ County, _____” executed to be effective _____, by various persons. The Unit Agreement, in its Exhibit “A,” describes each Tract in the Unit Area, and in Exhibit “B,” shows on a map the boundary lines of the Unit Area and the Tracts included i n the Unit. The Unit Agreement and the Unit Operating Agreement provide that any person may become a party to the Agreements by signing the original, counterpart, or other instrument whic h evidences an intention to be bound by the terms of the Agreements. Each of the undersigned owners represents that he/she/it is the owner of a working interest or a royalty interest, or both, as defined in the Unit Agreement, in one or more of the Tracts described in Exhibit “A” of the Unit Agreement. For adequate consideration, each of the royalty owners who signs this instrument agrees to become a party to and be bound by the provisions of the Unit Agreement as if the original of that Agreement had been signed; and, each of the working interest owners who signs this instrument agrees to become a party to and be bound by the provisions of the Unit Agreement and the Unit Operating Agreement, as if the originals of those Agreements had been signed. Each of the undersigned owners agree that the parties to the Unit Agreement and the Uni t Operating Agreement are those that sign the originals, any counterparts of the instruments, or any instrument which evidences an intention to be so bound. This Joinder is executed by the undersigned as of the date of the acknowledgment of the undersigned’s signature, but shall be deemed effective as of the Effective Date of the Uni t Agreement.
