Refund, Withdrawal and Cancellation Policy

The following refund schedule applies unless alternate terms are agreed in writing: deposits are non-refundable except where the institution cancels the course prior to the start date. Withdrawal more than 14 days prior to the program start date entitles the student to a refund of tuition less the non-refundable deposit. Withdrawal within 14 days of the start date or after commencement of instruction is subject to prorated refunds at the institution's sole discretion and may include administrative withdrawal fees. No refunds will be issued for failure to attend or for disciplinary dismissals except as required by applicable law.

Academic Policies and Student Obligations

Student agrees to comply with all academic policies, attendance requirements, assignment deadlines, and standards of academic honesty as established by the institution. Failure to meet course requirements may result in grade penalties or dismissal from the course and will not relieve the student of financial obligations unless a formal withdrawal is accepted under the refund policy above.

Attendance: For synchronous sessions, a single absence does not constitute withdrawal. Repeated absences without notice may be treated as voluntary withdrawal. For asynchronous courses, completion benchmarks and participation requirements are set in course materials.

Technical Requirements and Recordings

The institution may record live sessions for educational purposes; recordings may be shared with enrolled students only. By signing, student consents to being recorded during synchronous sessions.
I consent to the recording and educational use of live sessions.

Privacy, Liability and Indemnification

The institution will use and store student information in accordance with its privacy practices. The institution is not liable for technical interruptions beyond its reasonable control. To the fullest extent permitted by law, the student (or guardian) releases and holds harmless the institution, its officers, employees and agents from claims arising out of participation in online instruction, except in cases of willful misconduct or gross negligence.

Indemnification: Student agrees to indemnify and defend the institution against any claims, liabilities, losses, or expenses (including reasonable attorney fees) arising from the student's breach of this agreement or violation of institutional policies.

Dispute Resolution and Governing Law

Any dispute arising out of or relating to this contract shall be resolved by negotiation between the parties. If unresolved, the dispute will be governed by the laws of the state specified by the institution in the enrollment paperwork. The parties agree that any arbitration or litigation shall be conducted in the chosen jurisdiction unless otherwise prohibited by law.

This contract constitutes the entire agreement between the parties regarding enrollment and supersedes any prior agreements or representations. If any provision is held invalid, the remaining provisions remain in full force and effect.

What the Online Classes Enrollment Contract Covers

An Online Classes Enrollment Contract is a written agreement that documents a student’s or guardian’s enrollment in one or more virtual courses, the scope of instruction, payment and refund terms, attendance expectations, and any required materials or technology. It identifies the parties, course dates, fees, cancellation and transfer policies, accessibility and accommodations, and consent for electronic delivery and signatures. The contract is commonly used by schools, training providers, continuing education programs, and private instructors to set clear rights and obligations before classes begin.

Why a Formal Enrollment Contract Matters

A clear written contract reduces disputes, sets expectations for tuition and refunds, documents consent for online delivery, and provides a durable record suitable for audit or regulatory review. It also supports consistent processes for admissions, billing, and compliance with student privacy rules.

Why a Formal Enrollment Contract Matters

Who Typically Completes an Enrollment Contract

Use the document to capture signatures, payment authorizations, and any disclosures required by federal or state law before students access course materials.

  • K–12 and higher-education registrars managing cohort admissions, payment plans, and FERPA compliance.
  • Continuing education and professional trainers enrolling adult learners and recording credit or CEU eligibility.
  • Parents or legal guardians signing on behalf of minors for program permission and liability acknowledgements.

Required Data Elements in the Contract

Common Mistakes to Avoid

  • Using informal language or vague refund terms that create ambiguity in enforcement and lead to disputes.
  • Collecting incomplete or inconsistent contact information that prevents delivery of notices or course access credentials.
  • Failing to obtain guardian signatures for minors, which can render the contract unenforceable for certain obligations.
  • Not preserving a tamper-evident signed copy or audit trail, complicating compliance reviews and dispute resolution.

Risks When the Contract Is Incorrect or Missing

Enrollment Loss: Tuition forfeiture
Legal Challenge: Enforceability risk
FERPA Violation: Privacy breach risk
Billing Errors: Chargebacks or withholding
Regulatory Fines: State penalties possible
Reputational Harm: Public complaints and reviews
