Proctor Duties and Responsibilities

The Proctor shall: (a) verify the identity of the Student in accordance with Institution policies; (b) ensure the testing environment complies with the Institution's instructions for permitted materials and conditions; (c) prevent communication or cheating during the examination; (d) maintain the security and confidentiality of all examination materials; and (e) submit an incident report to the Institution immediately upon observing any irregularity. Indemnification and Liability

The Proctor agrees to indemnify, defend and hold harmless the Institution, its trustees, officers, employees and agents from and against any and all claims, liabilities, damages, losses and expenses arising out of or in connection with the Proctor's negligent acts or intentional misconduct in the performance of proctoring duties. The Institution's liability for any claim related to this Agreement shall be limited to direct damages and shall not include consequential, incidental or punitive damages.

This Agreement commences on the Effective Date and applies to the exam session described above. Either party may terminate this Agreement for cause upon written notice if the other party materially breaches its obligations. Upon termination or completion of proctoring services, the Proctor must return or securely destroy all examination materials and provide documentation of disposition to the Institution within days.

If remote proctoring is used, the Proctor and Institution shall comply with applicable privacy and data protection obligations. The Proctor may capture recordings or logs only to the extent authorized for the exam and shall ensure secure storage and limited access. Any request for disclosure of recorded materials shall be directed to the Institution for approval prior to release.
