What the Property Manager Employment Agreement Is

A Property Manager Employment Agreement is a written contract that defines the relationship between an employer (owner or management company) and an employee hired to manage rental property. It sets duties, compensation, work location, schedule, performance expectations, reporting lines, confidentiality, and grounds for termination. The agreement clarifies payroll and tax treatment, benefit eligibility, and any reimbursement arrangements, and it often includes noncompete, nondisclosure, and ownership-of-work provisions tailored to real estate operations and fair housing obligations.

Why a Clear Written Agreement Matters

A written employment agreement reduces disputes by documenting responsibilities, pay, and termination rules; it also establishes tax and benefits treatment and protects confidential landlord information.

Why a Clear Written Agreement Matters

Who Typically Uses This Agreement and Why

Owners, property management firms, and in-house real estate teams use this agreement to formalize employment terms and reduce ambiguity during leasing, maintenance, and tenant interactions.

  • Independent landlords hiring a full-time on-site manager for multiple units or portfolios.
  • Property management companies engaging salaried or hourly staff for leasing and maintenance oversight.
  • Real estate investors hiring a manager to handle tenant relations, vendor contracting, and rent collection.

It is also used by recruitment and HR teams to ensure consistent onboarding, to support payroll classification, and to meet recordkeeping and compliance obligations.

Core Sections to Include in a Professional Agreement

A well-drafted Property Manager Employment Agreement combines operational detail with legal protections. Include clear, actionable clauses so both parties understand duties, limits, and remedies.

Duties

Describe specific responsibilities: leasing, rent collection, maintenance supervision, vendor selection, tenant screening, reporting frequency, and escalation procedures.

Compensation

State salary or hourly rate, bonus or commission structure, payroll schedule, expense reimbursement policy, and any benefits or perquisites.

Term and Renewal

Specify start date, fixed-term or at-will status, auto-renewal conditions, and notice periods required for nonrenewal or nonextension.

Termination

Define termination for cause vs. without cause, notice requirements, final pay timing, and post-termination obligations.

Confidentiality

Include nondisclosure of tenant data, owner financials, vendor rates, and trade secrets; address return of records at separation.

Indemnification & Liability

Allocate responsibility for third-party claims, specify insurance requirements, and limit employee liability consistent with state labor law.

Step-by-Step: Completing the Agreement

Follow a simple sequence to complete and validate the agreement so it is enforceable and operational from day one.
