Release and Indemnification Agreement Given by Registered Guest at Hotel or Motel Regarding Unregistered Occupants or Visitors in Guest’s Room Whereas, ____________ Hotel located at _______________________ (street address, city, state, zip code) offers lodging to its registered guests; and Whereas, the undersigned ________________ (name of guest) (hereinafter called Guest) desires to register as a guest at ____________ Hotel; and Whereas Guest understands and agrees that only the number of persons registered as occupying Guest’s room shall so occupy it, and in no case shall unregistered persons be permitted to occupy the room. Now, therefore, for and in consideration of the aforesaid services to be rendered by __________ Hotel , the undersigned Guest hereby releases ____________ Hotel, its employees, officers, directors, successors, and assigns (collectively Releasees) from all liability to the undersigned and any visitors to the room of the undersigned for any loss or damage to property, physical injury or death whether caused by Releasees or otherwise that result, directly or indirectly from an unregistered visitor or other such person in Guest’s room. The undersigned further agree to indemnify, save and hold Releasees harmless from any loss, liability, attorneys’ fees, damage, or costs that they (or any of them) may incur arising out of or related to anyone other than Guest occupying or visiting in Guest’s room during the period of time that Guest is registered to stay at ____________ Hotel. This Agreement shall be governed by the laws of the State of ____________. The parties hereby agree that any dispute under this Agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
