What a Remote Work from Home Agreement Is

A Remote Work from Home Agreement is a written contract that defines the terms under which an employee performs work remotely. It clarifies scope of duties, hours, location, equipment, expense reimbursement, data security, confidentiality, and termination processes so both employer and employee understand responsibilities and expectations in a telework arrangement.

Why a Clear Remote Work from Home Agreement Matters

A well-drafted agreement reduces misunderstandings, protects confidential information, establishes payroll and tax responsibilities, and sets rules for equipment and reimbursement. It provides legal clarity if disputes arise and supports consistent HR administration across remote and in-office populations.

Why a Clear Remote Work from Home Agreement Matters

Who Typically Uses a Remote Work from Home Agreement

Employers and employees use this agreement to set clear expectations for remote work arrangements and reduce operational and compliance risk.

  • Human resources and talent teams managing telework policies, onboarding, and compliance for distributed staff.
  • Managers and supervisors documenting hours, deliverables, and supervision methods for remote direct reports.
  • Individual employees or contractors formalizing work location, schedule, equipment, and confidentiality obligations.

Use the agreement to document decisions consistently and to reference during performance reviews, expense disputes, or legal questions.

Core Sections to Include in the Agreement

A professional Remote Work from Home Agreement should be complete, legally sensible, and tailored to the role. The following elements help create a practical, enforceable document.

Scope of Work

Clear description of duties, deliverables, reporting relationships, and any performance metrics. Avoid ambiguity about responsibilities to prevent disagreements over remote expectations.

Hours & Availability

State regular work hours, required overlap with teammates, on-call expectations, break and overtime rules, and procedures for requesting schedule changes or time off.

Equipment & Expenses

Specify employer- or employee-provided equipment, responsibility for maintenance, reimbursement policy for approved expenses, and procedures for returning company property.

Security & Data Protection

Define required security measures (VPN, device encryption, password rules), data handling, and any additional protections to meet HIPAA, FERPA, or company policies.

Confidentiality & IP

Include nondisclosure language, ownership of work product, and any invention assignment provisions tailored to the role and state law limitations.

Termination & Review

Outline notice periods, grounds for revoking remote privileges, return-of-equipment obligations, and scheduled reviews of the remote arrangement.
