What a Remote Work Home Office Agreement Is

A Remote Work Home Office Agreement is a written contract that sets expectations between an employer and a remote employee about location of work, hours, equipment, security, expense reimbursement, and termination. It documents responsibilities for tax, workers' compensation, data protection, and intellectual property, and creates a record that supports compliance with federal and state employment laws and electronic signature statutes such as the ESIGN Act (15 U.S.C. ch. 96) and state UETA adoption.

Why this agreement matters for employers and employees

A clear written agreement reduces misunderstandings about responsibilities, protects both parties on pay and benefits, and documents security and equipment standards that may be required for regulatory compliance or insurance.

Why this agreement matters for employers and employees

Who typically completes a Remote Work Home Office Agreement

The agreement is used by a mix of HR, managers, and remote staff to document terms and approvals before remote work begins.

  • Human Resources teams managing policies, payroll, and benefits for remote staff.
  • Hiring managers approving schedule, deliverables, and supervisory requirements.
  • Remote employees acknowledging workplace rules, equipment lists, and security responsibilities.

Use the agreement to establish a consistent process for onboarding, auditing, and renewing remote work arrangements across the organization.
