If the payment is not made within a reasonable time (the said time must be within five days of filing of the said charge and the aforesaid date of service of process), plaintiff may institute this action in any court of law, the same to be in the name of plaintiff and the same may contain such other matter as, in the court's opinion, is just. A copy of complaint, or any part thereof, must first be served upon the defendant at its principal place of business in the county where the business of defendant is carried on, and then the defendant's service within the county of the filing of said complaint. This action upon a demand for payment shall be commenced within seven days of the service, or the amount of the late charges shall become, as aforesaid, late to the defendant, after deducting the amount of the payment for which it is due, and the payment for said late charges must be made within two hours after such date of being served, whether the service was in person or by mail. 12.
