Except for Seller's obligations under the express warranty contained in this Extension, neither party shall be liable to the other for incidental, special, consequential or punitive damages arising out of or related to this Extension, whether in contract, tort (including negligence) or otherwise. The aggregate liability of Seller for any claim arising under or in connection with this Extension shall not exceed the Total amount paid to Seller under the Original Agreement and this Extension for the candidate items giving rise to the claim.

This Extension shall be governed by and construed in accordance with the laws of the state of without regard to its conflict of law rules.
