STAFFING ENROLLMENT AGREEMENT

This Staffing Enrollment Agreement (Agreement) is made and entered into by and between Staffing Provider Name: (Provider) and Staff Member: (Enrollee). The parties agree as set forth below.

1. Enrollment and Scope

1.1 Enrollment: Provider hereby enrolls Enrollee in Provider's staffing pool for assignment to educational institutions and programs. Enrollee consents to consideration for temporary, long-term, substitute, or permanent assignments as determined by Provider and client schools.

3. Assignment Terms, Termination, and At-Will Status

3.1 Term: This Agreement becomes effective on Enrollment Effective Date: and continues until terminated in accordance with this Agreement.

3.2 At-Will and Termination: Enrollee acknowledges that assignments may be offered on an at-will basis. Either party may terminate Enrollee's participation in the staffing pool or a particular assignment at any time for any lawful reason upon notice to the other party. Provider reserves the right to remove Enrollee from the pool for cause, including but not limited to substantiated misconduct, unsatisfactory performance, material misrepresentation, failure to comply with client policies, or failure to obtain required clearances.

4. Compensation, Timekeeping, and Benefits

4.1 Pay Rate: Agreed pay rate: per hour, per diem, or as otherwise agreed in writing for each assignment.

4.2 Timekeeping and Payment: Enrollee must submit timesheets or other contemporaneous records as required by Provider. Provider will invoice client schools and/or pay Enrollee in accordance with Provider's payroll policies. Provider is solely responsible for payroll processing, withholding and remittance of applicable taxes for employees; if Enrollee is engaged as an independent contractor for a particular assignment, Provider will notify Enrollee in writing and any such arrangement will be governed by a separate agreement.

5. Background Checks, Clearances, and Compliance

5.1 Required Clearances: Enrollee understands that acceptance of assignments is contingent upon successful completion of all required screenings, which may include criminal background checks, fingerprinting, child abuse registry checks, drug screening, and verification of vaccination or immunization status, where lawfully permitted.

5.2 Consent to Screenings: By checking the box below, Enrollee expressly authorizes Provider and its authorized representatives to obtain and review consumer reports and other background information necessary to evaluate suitability for assignment.

6. Policies, Training, and Conduct

6.1 Policies and Training: Enrollee agrees to comply with Provider's and client school policies, procedures, and training requirements, including mandatory reporting obligations related to child protection and student welfare. Enrollee must complete assigned trainings prior to or during initial placement when required.

6.2 Professional Conduct: Enrollee warrants that Enrollee will perform duties professionally and in compliance with laws and ethical standards applicable to work with minors and students. Any conduct that jeopardizes student safety or violates client rules may result in immediate removal from assignment and/or termination.

7. Confidentiality and Records

7.1 Confidential Information: Enrollee acknowledges that during assignments Enrollee may have access to confidential student, personnel, or operational information. Enrollee agrees not to disclose, use, or retain confidential or personally identifiable information except as required to perform duties and as permitted by law. This obligation survives termination of this Agreement.

8. Liability, Indemnification, and Insurance

8.1 Liability and Indemnity: Enrollee agrees to indemnify Provider for damages arising from Enrollee's intentional misconduct or material breach. Provider agrees to maintain commercially reasonable insurance for liability arising out of its operations. Nothing in this Agreement limits client school authority to remove Enrollee from assignment.

9. Representations and Acknowledgments

9.1 Representations: Enrollee represents that all information provided to Provider is true, complete, and accurate. Enrollee will promptly notify Provider of any changes to qualifications, legal status, address, contact information, or any event that would affect eligibility to work with children or as required by law.

9.2 Certification: By signing below Enrollee certifies under penalty of perjury that all statements and documents provided in connection with this Agreement are true, and understands that false statements may result in removal from the staffing pool, termination, and potential legal consequences.

Notices required under this Agreement shall be made in writing to the addresses provided by the parties in this form and shall be effective when delivered via hand, nationally recognized overnight courier, or other method agreed in writing.

12. Miscellaneous

12.1 Governing Law: This Agreement shall be governed by the laws of the jurisdiction in which the assignment is performed, without regard to conflict-of-law principles.

12.2 Entire Agreement: This document constitutes the entire agreement between the parties regarding enrollment in Provider's staffing pool and supersedes prior oral or written representations, except where a separate written employment or contractor agreement exists.
