Home Builder's Warranty Agreement _____________________ (Name of Contractor), of ____________________________ ____________________________________________ (street address, city, state, zip code), hereinafter called Contractor, hereby warrants to ____________________ (Name of Buyer), of ____________________________________________________________________________ (street address, city, state, zip code), ____________________________________________ ______________________________________ (address of buyer), as follows: 1. The following described house: (description and address of house) ______________ __________________________________________________________________________________________________________ has been constructed in accordance with accepted home building practices. It has been inspected by trained personnel of Contractor and, where required, by the building department of the area in which it is situated. 2. Contractor guarantees against defects in the quality of work and materials for a period of ______ (number) years with regard to the following items:  plumbing system;  heating system, if installed;  roof against leaks;  electric wiring system; and  septic tank, if installed. 3. Contractor agrees that upon receipt of a written request from Owner within ______ (number) days of the date of this Warranty, Contractor will make an inspection of Owner's house and adjust or repair the following items when needed:  doors, including hardware;  windows;  electric switches, receptacles, and fixtures;  caulking around exterior openings;  plumbing fixtures; and  cabinet work. 4. Contractor shall be liable only to the limit of the manufacturer's warranty for appliances and equipment such as refrigerator, range, space h
C., microwave, dishwasher, etc. 5. The owner is hereby required to furnish a copy of the written repair report to contractor at the time that it is delivered to purchaser. The repair report shall include the name and address of the contractor (the address where the work is performed under the warranty), the name of the manufacturer and model of the appliance or equipment and the description of any condition that is defective and includes in the repair report any estimated cost to repair it. In addition, the repair report shall contain the name and address of the original contractor and, if the repairs are to an electrical fixture, the electrical circuit number of the installation (the number is on the side or bottom of the electrical board or the receptacle). Whenever a buyer is the first to use the materials and implements purchased, the seller shall in the event of any defect or failure under the contract, make the repairs at the time he receives the purchaser's written demand, and shall pay the amount of repairs at the time it is billed.
