What a Student Agreement Is and when it applies

The Student Agreement is a written contract between a student and an educational provider that defines enrollment terms, conduct expectations, tuition and fee obligations, housing and technology policies, confidentiality and intellectual property provisions, and dispute resolution procedures. It documents effective and termination dates, financial conditions, and any attachments or exhibits. Student Agreements are used for enrollment, campus housing, clinical placements, internships, and continuing-education programs and can be executed electronically where statutory exceptions do not apply.

Why the Student Agreement matters for both parties

A clear Student Agreement reduces disputes by documenting responsibilities, payment terms, privacy consents, and disciplinary procedures. When executed consistent with ESIGN and UETA, signatures are generally admissible and enforceable across U.S. jurisdictions except where law requires a wet-ink signature or other statutory exception.

Why the Student Agreement matters for both parties

Who completes and manages Student Agreements

Completion and management duties are shared among students, institutional staff, and parents or guardians where applicable.

  • Students: complete enrollment terms, acknowledge policies, and sign to accept responsibilities.
  • Registrar or admissions staff: prepare the agreement, set effective dates, and manage records.
  • Parents or guardians: sign for minors, confirm financial responsibility, and provide emergency contacts.

Accurate completion and timely filing with the registrar or student records office ensure enforceability and reduce administrative holds.

Core sections to include in a professional Student Agreement

A complete Student Agreement organizes terms into discrete sections so obligations, fees, conduct rules, and remedies are clear to all parties.

Parties

Identify each contracting party by full legal name, indicate student status (undergraduate, graduate, nondegree), list guardian details for minors, and provide official contact information for notices and billing.

Term

Specify the effective date and agreement duration, conditions for renewal or re-enrollment, and procedures that trigger suspension or early termination of access and services.

Tuition & Fees

Detail tuition amounts, installment schedules, accepted payment methods, late fees, refund schedules, and the institution's policy for holds on registration and transcript release.

Code of Conduct

State academic integrity standards, behavioral expectations, disciplinary procedures, possible sanctions, and the appeals process including timelines for filing appeals.

Privacy & Records

Describe FERPA rights, consent language for disclosure of education records, any HIPAA considerations for student health services, and how records will be accessed and shared.

Termination & Remedies

List grounds for termination, notice and cure procedures, refund treatment on termination, and chosen dispute resolution method such as arbitration or court jurisdiction.
