Waiver, Release and Indemnification

In consideration for participation in the basketball program, the undersigned acknowledges and agrees that participation involves inherent risks including but not limited to sprains, fractures, concussion, and other injuries and that such risks may result from the actions or omissions of others. The undersigned freely and voluntarily assumes all such risks and accepts responsibility for any injury, loss, or damage sustained.

The undersigned hereby releases, waives, discharges, and covenants not to sue the school district, school, program organizers, coaches, volunteers, sponsors, and their respective agents, employees, and representatives (collectively, the Released Parties) from any and all liability for any loss, damage, injury, or death to person or property, whether caused by the negligence of the Released Parties or otherwise, arising out of or connected in any way with participation in the basketball program.

The undersigned further agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or resulting from the undersigned's or the participant's act, omission, or breach of this agreement.

The undersigned authorizes program staff and medical personnel to administer or obtain emergency medical treatment for the participant and acknowledges that the undersigned is responsible for the cost of such treatment and any transportation to obtain care.

The undersigned agrees to comply with program rules, directions of coaches and staff, and acknowledges that failure to do so may result in suspension or removal from the program without refund. The undersigned certifies that the participant is physically able to participate.
