STUDENT CLIENT AGREEMENT

This Student Client Agreement (the Agreement) is entered into effective on between the educational service provider below and the student client identified herein.

The Provider will deliver the services described above in a manner consistent with its professional standards. The scheduling of sessions and any make-up sessions are governed by the Provider's attendance policy set forth below.

Refunds: Except as expressly stated in the Provider's refund policy below, fees paid are non-refundable once services have commenced. Any exception must be approved in writing by an authorized representative of the Provider.

Student Responsibilities; Attendance; Conduct

The Student agrees to attend scheduled sessions, to arrive prepared, and to comply with the Provider's code of conduct. Chronic unexcused absences may result in suspension of services or termination of this Agreement. The Student is responsible for completing assigned work and providing truthful information regarding academic history and needs.

Make-Up Sessions: The Provider will attempt to schedule make-up sessions for sessions canceled by the Provider. For cancellations by the Student, make-up sessions are at the Provider's discretion and may require advance notice as described in the Provider's scheduling policy.

I acknowledge that I have read, understand, and will comply with the attendance and conduct provisions of this Agreement.

Confidentiality and Records

The Provider will treat records and information obtained in the course of providing services as confidential and will not disclose such information except as required by law or with written consent of the Student or Parent/Guardian where applicable. The Provider may keep educational records, attendance logs, and progress notes as necessary for the provision of services.

Consent to Share Records with Parent/Guardian: I authorize the Provider to share pertinent educational records and progress information with the Parent/Guardian listed above.

Media Release: I authorize the use of my student's photograph or non-identifying work samples for Provider promotional or educational purposes unless I opt out by leaving this box unchecked.

Liability, Indemnification, and Insurance

The Provider's liability for any claim arising out of the services provided under this Agreement is limited to direct damages not to exceed the amount of fees paid by the Student under this Agreement. The Student (and Parent/Guardian where applicable) agrees to indemnify and hold harmless the Provider from claims arising from the Student's breach of this Agreement or negligent acts during participation in Provider activities. The Provider maintains appropriate liability coverage where required by law or applicable standards.

I acknowledge and accept the limitation of liability and indemnification provisions contained in this Agreement.

Termination; Cancellation; Remedies

Either party may terminate this Agreement upon written notice to the other party. The Provider may terminate immediate services for cause, including violations of conduct rules or non-payment. Upon termination, any amounts owing to the Provider for services rendered through the date of termination become immediately due and payable.

Dispute Resolution

The parties agree to attempt to resolve disputes arising under this Agreement by good faith negotiation. If the parties cannot resolve a dispute within a reasonable time, they agree to submit the dispute to mediation. If mediation is unsuccessful, the dispute may be resolved by arbitration or litigation as elected by the Provider. The prevailing party in any dispute is entitled to recover reasonable costs and attorneys' fees as permitted by applicable law.
