Standards of Conduct

Students are expected to conduct themselves with integrity, respect, and responsibility. Prohibited conduct includes, but is not limited to, the following:

Use of Technology and Social Media

Electronic devices and network services provided by the institution must be used responsibly. Unauthorized access, cyberbullying, distribution of prohibited content, or any conduct that substantially disrupts the learning environment is subject to disciplinary action. Off-campus online conduct that materially and substantially interferes with school operations or student safety may also be disciplined.

Attendance, Dress, and Classroom Conduct

Students are required to attend scheduled classes, arrive on time, and adhere to dress expectations adopted by the institution. Repeated unexcused absences, chronic tardiness, or failure to follow reasonable classroom rules may result in sanctions.

Investigation and Disciplinary Procedures

Allegations of misconduct will be investigated promptly and impartially. Prior to imposition of disciplinary sanctions, the student will receive notice of the allegation and an opportunity to respond. Emergency removal may occur when the student's presence poses an immediate threat to safety; such removal is temporary pending a timely review. Sanctions may include reprimand, restitution, community service, suspension, or expulsion depending on severity and prior discipline history.

Due Process and Appeals

The student has the right to be informed of the allegations, review evidence as permitted by applicable privacy laws, and present information or witnesses. A decision-maker independent of the investigation will render a determination. A written notice of outcome and any sanctions will be provided. The student may appeal the determination within a specified period on grounds of procedural error, new evidence, or disproportionate sanction.

Bullying, Harassment and Non-Discrimination

The institution prohibits bullying and harassment based on protected characteristics. Reports will be investigated and appropriate remedial action taken. Retaliation against individuals who report misconduct in good faith or who participate in investigations is prohibited and will itself be subject to discipline.

Searches and Seizure

School officials may conduct searches of lockers, desks, electronic devices, and personal effects when there is reasonable suspicion of a violation of law or school policy. Seized items will be held as evidence or returned as appropriate. Searches are conducted in a manner intended to preserve privacy to the extent practicable.

Mandatory Reporting

Certain staff members are required by law to report suspected child abuse or neglect to the appropriate civil authorities. Such reports may proceed irrespective of parallel school disciplinary processes.

What the Student Code of Conduct Covers

A Student Code of Conduct is a written set of rules, standards, and procedures schools use to define acceptable behavior, outline reporting and investigation processes, and describe disciplinary outcomes. It typically applies to students while on campus, at school-sponsored events, and in certain online activities tied to the institution. A clear code helps administrators act consistently, informs students and families of expectations, and documents processes required for due process or appeals. Many institutions pair the code with privacy, accommodation, and academic integrity policies to form a complete student governance framework.

Why an Explicit Code Matters for Schools

A written Student Code of Conduct creates predictable standards, reduces disputes, and supports fair, documented disciplinary processes that stand up to review under institutional policy and applicable law, including FERPA and general contract principles.

Why an Explicit Code Matters for Schools

Who Relies on the Student Code of Conduct

Multiple groups use or consult the code when addressing student behavior, investigations, or policy updates.

  • School administrators and conduct officers who manage investigations and determine sanctions.
  • Students and families who need to understand rights, reporting options, and appeal timelines.
  • Faculty and staff who enforce classroom expectations and refer incidents to conduct offices.

Clear distribution and periodic review ensure each group understands obligations and available remedies under the code.

Core Elements to Include in a Professional Code

A professional Student Code of Conduct organizes policy text so readers can quickly locate definitions, reporting channels, investigative steps, and sanctions while preserving procedural safeguards.

Scope

Define who is covered (students, affiliates), where the code applies (on campus, off-campus events, online activities), and temporal coverage for alleged conduct.

Definitions

Provide clear definitions for key terms such as misconduct, harassment, academic dishonesty, and retaliation to avoid ambiguity during investigations.

Reporting

Describe how to report incidents, options for anonymous reports, confidentiality expectations, and mandated reporter obligations.

Investigation Process

Explain steps for intake, notice to parties, evidence gathering, interviews, standard of proof, and estimated timelines for resolution.

Sanctions

List possible outcomes from warnings to suspension or expulsion and note interim measures such as no-contact orders or temporary removal.

Appeals and Records

Outline appeal grounds, filing windows, procedural review types, and how disciplinary records are maintained or disclosed.

Essential Information Fields

Student Name: Full legal name
Student ID: Unique campus identifier
Date of Report: MM/DD/YYYY
Location: Campus or off-campus site
Allegation Summary: Concise incident description
Signatures: Required signatory entries

How to Complete the Code Documentation

Follow a consistent sequence when preparing or updating a Student Code of Conduct to ensure accuracy and enforceability.

  • 01
Gather materials: Collect existing policies, union agreements, and state law references.
  • 02
Draft text: Write clear sections for scope, definitions, procedures, and sanctions.
  • 03
Review legally: Have counsel check legal compliance with FERPA and state statutes.
  • 04
Publish and train: Distribute to the community and provide training for implementers.

Customizing the Online Code Workflow

Set up an online workflow that captures reports, routes them to administrators, and records each action for a transparent audit trail.

Field Configuration
Intake Form Required fields, file upload, and anonymity toggle
Routing Rules Auto-assign based on location, severity, or role
Notifications Email/SMS updates for parties and investigators
Audit Trail Record timestamps, user actions, and exports

Where the Code Document Is Filed and Sent

Understand typical destinations and custody for reports and final disciplinary records to ensure appropriate confidentiality and retention.

  • Conduct Office: Primary custodian for investigative files and sanctions
  • Registrar: Receives sanction notices affecting enrollment
  • Student Records: Long-term storage subject to retention policy
  • Legal Counsel: Receives copies when legal review or litigation is likely

Digital Signing and eSubmission Requirements

When accepting electronic signatures or e-submissions, ensure authentication, audit trails, and secure storage meet institutional and legal standards.

  • Authentication: Use multifactor or access-controlled accounts
  • Audit Trail: Capture IP, timestamps, and signer actions
  • Encryption: Protect data in transit and at rest

Typical Timelines and Notice Deadlines

Timelines in a Student Code of Conduct define notice, investigation, hearing, and appeal windows to preserve due process and timely resolution.

Initial Notice to Student:

Usually within 5–10 business days of intake

Investigation Period:

Commonly 15–30 calendar days, extendable for complexity

Hearing Scheduling:

Set within 10–20 business days after notice

Appeal Filing Window:

Typically 7–14 calendar days from decision

Record Access Requests:

FERPA response timelines apply for student records

Common Mistakes When Preparing or Applying the Code

  • Vague definitions that leave interpretation to ad hoc decision-making and increase appeal risk.
  • Inconsistent notice or service of process that undermines procedural fairness and invites legal challenge.
  • Failing to align sanctions with published ranges, leading to perceptions of arbitrariness or discrimination.
  • Poor recordkeeping that destroys audit trails needed to demonstrate intent, notice, or chain of custody.

Potential Penalties and Legal Risks

Disciplinary Sanctions: Warning to expulsion
Academic Penalties: Grade reduction or course failure
Loss of Privileges: Housing or activity suspension
Civil Liability: Possible lawsuits
FERPA Risk: Improper disclosure sanctions
Reputational Harm: Institutional trust impacts
