STUDENT CONDUCT STANDARDS

Institution Name:

Student Information

Parent / Guardian Information (if student is a minor)

Student is under 18:

Standards of Conduct

The following standards are applicable to all students while on campus, at school-sponsored events, during school transportation, and when conduct materially affects the school environment. Students are expected to act with integrity, respect for others, and compliance with school rules and applicable law.

Effective Date of These Standards:

Prohibited Behavior (non-exhaustive)

The following actions constitute violations and may result in disciplinary sanctions up to suspension or expulsion, and referral to civil or criminal authorities where appropriate:

Disciplinary Procedures and Due Process

Reports of alleged violations will be investigated by school officials. The investigative process may include interviews with the reporting party, the respondent, and witnesses; review of records and evidence; and issuance of interim measures to protect safety and preserve the educational environment.

Where the investigation indicates a violation, disciplinary measures may include reprimand, restitution, loss of privileges, suspension, or expulsion. Any sanction imposed will be proportionate to the severity of the violation and the student's disciplinary history.

Students and/or guardians shall receive written notice of allegations and proposed sanctions and shall have the opportunity to respond prior to imposition of long-term suspension or expulsion, except where interim removal is necessary for safety. Appeal rights are available and shall be exercised in accordance with school policy.

Reporting, Confidentiality, and Mandatory Reporting

The school will make reasonable efforts to protect the privacy of all parties to the extent permitted by law. However, confidentiality cannot be guaranteed when disclosure is required by mandatory reporting obligations or when disclosure is necessary to ensure safety. Information may be shared with appropriate administrative or law enforcement authorities as permitted or required by law.

Searches and Seizures

School officials may search student property, including lockers, bags, and electronic devices, where there is reasonable suspicion of a policy violation or threat to safety. Items discovered that violate school policy or law may be seized and retained in accordance with school procedure.

Technology Use and Electronic Conduct

Use of school technology resources must comply with acceptable use policies. Electronic harassment, cyberbullying, and unauthorized access to data or systems are subject to disciplinary action whether they occur on or off campus when they materially disrupt the school community.

What the Student Conduct Standards cover and why they matter

Student Conduct Standards is an institutional policy that defines expected behavior, outlines prohibited conduct, and sets the procedures for reporting, investigating, and resolving alleged violations. It provides notice to students and staff about jurisdiction, interim measures, disciplinary sanctions, appeal rights, and recordkeeping. The document aligns institutional practice with federal privacy and civil-rights laws such as FERPA and Title IX while allowing consistent case handling across departments, campuses, and enrollment statuses.

Why a clear standard is essential for fairness and compliance

A written Student Conduct Standards policy establishes clear expectations, protects due process, and reduces liability by documenting procedures and outcomes. It helps institutions meet federal obligations under FERPA and Title IX while preserving transparency for affected students and staff.

Why a clear standard is essential for fairness and compliance

Who typically creates, reviews, and relies on these standards

Key campus stakeholders draft, maintain, and apply Student Conduct Standards to manage behavioral expectations and dispute resolution.

  • Student Affairs and Dean's Office: Operational owners who accept reports, coordinate investigations, and impose interim measures.
  • Title IX Coordinator or Compliance Office: Reviews cases involving sex discrimination and ensures regulatory compliance and mandated processes.
  • Legal Counsel and Records Office: Advises on policy language, privacy obligations, and retention requirements.

Departments should coordinate to ensure the policy is consistent with institutional code, state law, and federal obligations such as FERPA and Title IX.

Core elements every professional Student Conduct Standards should include

A complete policy should combine definitions, jurisdiction rules, procedural safeguards, and remedy options so administrators and students can rely on consistent, legally defensible practices.

Scope

Specifies who the policy covers, locations and activities in scope, and applicability to online or off-campus conduct.

Definitions

Clearly defines misconduct categories (e.g., harassment, academic dishonesty, threats), including examples and distinctions between minor and major violations.

Reporting

Describes how to file complaints, confidentiality limits, mandatory reporting obligations, and options for anonymous disclosure when allowed.

Investigation

Outlines steps, timelines, evidence rules, investigator roles, and standards of proof used during adjudication.

Sanctions

Lists potential disciplinary responses, factors for mitigation or aggravation, and whether restorative measures are available.

Appeals

Explains who may appeal, permissible grounds, deadlines, and the process for impartial review of decisions.

Required notices, privacy controls, and record elements

Confidentiality: FERPA-protected
FERPA Notice: Include rights
Access Controls: Role-based access
Investigation Log: Audit trail kept
Retention Tag: Retention policy noted
Medical Records: HIPAA when applicable

Stepwise process to prepare and publish Student Conduct Standards

Follow these sequential actions to draft, approve, and implement a standards document that is consistent and enforceable across campus.

  • 01
Draft: Assemble stakeholders and draft policy language with definitions and procedures.
  • 02
Review: Legal and compliance review for FERPA, Title IX, and state law alignment.
  • 03
Approve: Obtain governance or board approval per institutional rules before release.
  • 04
Publish: Post policy online, notify community, and train staff on implementation.

Configure an online workflow for incident reporting and adjudication

Mapping fields and routing in your eWorkflow reduces processing time and preserves an audit trail for later review.

Field Configuration
Template Name Student Conduct Standards template
Routing Order Reporter → Title IX Coordinator → Investigator

Retention Policy Apply institutional retention tag

Where to file, send, or submit conduct reports

Design clear routing so reports reach the correct office quickly and confidentiality is preserved during transfer.

  • Student Affairs: Primary recipient for non-Title IX conduct reports
  • Title IX Office: Receives complaints alleging sex discrimination
  • Human Resources: Handles staff-related conduct or dual-status incidents
  • Registrar: Records sanctions affecting enrollment

Technical considerations for eSubmission and case management

Ensure chosen platforms support privacy, audit trails, and integrations with campus systems.

  • File formats: PDF, DOCX accepted
  • Integrations: Works with Google Workspace
  • Authentication: Email plus optional MFA

Select an eSubmission tool that provides secure storage, an audit trail, and the ability to export records for legal review.

Typical timeframes and deadlines to include in policy

Institutions often set internal deadlines for reporting and investigation; clearly state those periods so parties know timing expectations.

Report Timeframe:

Require prompt reporting; specify if 'as soon as practicable' or a fixed window.

Initial Assessment:

Conduct preliminary review within a short, defined period (often 3–10 business days).

Investigation Duration:

State an expected timeline (commonly 30–90 days) and note exceptions for complexity.

Sanctions Effective:

Indicate when sanctions take effect and whether interim measures are immediate.

Appeal Deadline:

Specify the time to file an appeal, typically measured in business days.

Common mistakes to avoid when preparing the standards

  • Using vague definitions that allow inconsistent enforcement and create due-process risk for the institution.
  • Failing to coordinate with legal counsel on FERPA or Title IX implications before publication.
  • Neglecting to document interim measures or to record the rationale for immediate actions.
  • Relying on informal communications instead of preserving investigations in the official record.

Risks and penalties for insufficient or incorrect standards

FERPA Exposure: Loss of privacy protections
Title IX Liability: Federal investigation risk
Legal Challenge: Due-process lawsuits
Reputational Harm: Public trust erosion
Enforcement Failure: Sanctions may be overturned
Delayed Resolution: Increased logistical costs
