Tuition, Fees, and Payment Terms

Tuition and charges are as follows and are due in accordance with the selected payment option. Student acknowledges responsibility for all charges incurred.

Late Payment: Late payments incur interest at a rate equal to 1.5% per month (or the maximum permitted by law) on outstanding balances until paid. Returned check fee:

Refund, Cancellation and Rescheduling

Enrollment Deposit is non-refundable except as required by applicable law. Refunds for prepaid tuition will be made on a pro rata basis for unused training hours, less any non-refundable fees and actual flight time logged. Cancellation or rescheduling of a lesson requires at least 48 hours' notice; otherwise a cancellation fee equal to the scheduled lesson charge may apply. Repeated no-shows or failure to comply with training rules may result in termination for cause under Section Termination below.

Assumption of Risk; Release; Indemnification

Student acknowledges that flight training involves inherent risks, including but not limited to aircraft accident, bodily injury, property damage, and death. To the fullest extent permitted by law, Student voluntarily assumes such risks and releases, holds harmless, and agrees to indemnify the School, its officers, employees, agents, instructors, and owners of aircraft used in training from claims, liabilities, losses, costs, and expenses arising from Student's participation in flight training, except to the extent caused by the School's gross negligence or willful misconduct as determined by a court of competent jurisdiction.

Medical Fitness and Regulatory Compliance

Student certifies that Student is physically and mentally able to participate in flight training and will immediately notify the School of any change in medical condition or medication that could affect safety. Where a medical certificate or other qualification is required for the training sought, Student shall present and maintain the required certificate(s). Student agrees to comply with all applicable aviation regulations and School safety policies. Failure to maintain required certification or to comply with safety rules may result in immediate suspension of training.

Records; Logbooks; Completion

The School will record training provided and endorse Student's logbook as appropriate. The School does not guarantee successful completion of any FAA or other certification test; performance depends on Student's aptitude, study, and adherence to training. Upon termination for any reason, records of training completed will be made available to Student upon request once outstanding obligations are settled.

Termination; Default

The School may suspend or terminate this Agreement and Student's training for reasons including but not limited to safety concerns, fraud, nonpayment, or material breach. In the event of termination by the School for cause, Student shall remain responsible for charges for training already provided and for any unpaid tuition or fees. If Student terminates, refunds will be handled as described in Refund, Cancellation and Rescheduling above.

Insurance

Student is encouraged to maintain personal health and personal liability insurance. The School maintains insurance on aircraft as required by its financier or policy; Student is responsible for damage caused by Student's negligent acts and may be financially liable for repairs or replacement as provided under separate rental agreements or insurance requirements.

Miscellaneous Provisions

Governing Law: The laws of the state of Governing State: shall govern this Agreement without regard to conflict of law principles. Any dispute arising under this Agreement shall be resolved in the courts located in the county in which the School's principal office is located, unless the parties mutually agree otherwise in writing.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect. Amendment: This Agreement may be amended only by a written instrument signed by both parties.

Acknowledgments and Consents

Student acknowledges receipt of the School's policies regarding safety, scheduling, and refunds and agrees to comply with them. Student consents to release of training records to certifying authorities as required by law or as necessary to process certification applications.
