Use, Care and Maintenance

Lessee (Student or Parent/Guardian) agrees to exercise reasonable care in the use, storage, and transport of the instrument, and to follow all care instructions provided. Unauthorized alterations or repairs are prohibited. If the instrument requires repair, Lessee must notify Lessor immediately and obtain prior written authorization for any repair work that will be charged to Lessor. Lessee is solely responsible for damage caused by misuse, neglect, or failure to follow instructions.

Loss, Theft, Damage and Insurance

Lessee is responsible for loss, theft, or damage to the rented instrument while in Lessee's custody. In the event of loss, theft, or irreparable damage, Lessee shall pay the documented replacement cost as determined by Lessor. Lessee is required to maintain insurance or enroll in the school instrument protection program when available. Proof of insurance or approval of protection enrollment must be provided prior to issuance.

Return, Inspection and Charges at Termination

Upon expiration or earlier termination of this Agreement, Lessee shall return the instrument and all accessories to Lessor in the same condition as issued, ordinary wear and tear excepted. Lessor shall inspect the instrument and provide Lessee with an itemized statement of repair or replacement charges within 30 days. Charges not contested in writing within 15 days are deemed accepted.

Default, Remedies and Indemnification

Failure to pay fees when due or breach of any material provision constitutes default. In the event of default, Lessor may repossess the instrument, declare all amounts due and payable, and pursue all available legal remedies. Lessee shall indemnify, defend, and hold harmless Lessor, its employees and agents from all claims, liabilities, costs and expenses (including reasonable attorneys' fees) arising from Lessee's possession, use or misuse of the instrument.

Acknowledgements and Authorizations

By signing below, Lessee (and Parent/Guardian if applicable) acknowledges receipt of the instrument described above, confirms understanding of and agreement to the terms and conditions set forth in this Agreement, authorizes the school to charge any unpaid fees or damage/replacement costs to the authorized payment method, and consents to reasonable inspections of the instrument while in Lessee's care.
