Participant Responsibilities & Code of Conduct

The Participant agrees to abide by all Program rules, safety instructions and directions of Program staff. The Participant accepts responsibility for personal conduct and property and acknowledges that failure to comply with Program rules may result in immediate dismissal without refund. The Participant specifically agrees to:

  • Participate in scheduled activities in a manner that does not endanger self or others;
  • Comply with attendance, punctuality and dress requirements;
  • Refrain from possession or use of illegal substances or dangerous items;
  • Notify staff of any unsafe conditions or incidents immediately.

The Participant hereby grants to the Program the irrevocable right to photograph, film, record and otherwise use Participant's likeness, image, voice or works created in connection with the Program for promotional, educational or archival purposes, subject to applicable privacy rules:

  

Liability, Assumption of Risk & Indemnification

Participant acknowledges that participation in the Program may involve foreseeable and unforeseeable risks, including but not limited to physical injury, illness, or property damage. Participant voluntarily assumes all risks associated with participation and releases the Program, its employees, officers, volunteers and agents from any and all liability for injury, loss or damage arising out of Participant's participation, except to the extent caused by the Program's gross negligence or willful misconduct.

Participant agrees to indemnify, defend and hold harmless the Program from and against any claims, demands, losses or liabilities (including reasonable attorneys' fees) arising out of Participant's breach of this Agreement, negligence, or misconduct.

Privacy, Confidentiality & Intellectual Property

Participant agrees that any confidential information or proprietary materials of the Program shall remain the property of the Program. Works created by Participant in the scope of Program activities may be used by the Program for educational or promotional purposes unless otherwise agreed in writing. Participant will not disclose confidential records of other Participants or sensitive Program operations.

Termination, Refunds & Withdrawal

Either party may terminate this Agreement for material breach following written notice and a reasonable opportunity to cure. In the event of Participant withdrawal, refund eligibility will be determined according to Program refund policies as set forth in the payment plan terms; Program may withhold fees for administrative costs and services already rendered.

Governing Law & Dispute Resolution

This Agreement shall be governed by the laws of the jurisdiction in which the Program operates, without regard to its conflicts of law principles. The parties agree to attempt good faith negotiation of disputes prior to initiating litigation; each party retains the right to seek injunctive relief where appropriate.
