Facilities, Equipment and Safety

Student acknowledges responsibility for safe operation of equipment and adherence to facility rules. Student will follow faculty supervision and safety protocols and will not bring hazardous materials on site without prior written authorization from the school representative named below.

Ownership, License and Use of Materials

Copyright Ownership: The parties acknowledge that original creative elements created solely by the Student are presumed to be owned by the Student unless otherwise agreed in writing. By checking the box below, the Student grants the school the license described in the following paragraph.

Student grants the School a non-exclusive, royalty-free, worldwide, perpetual license to reproduce, distribute, publicly display, perform and create derivative works of the production and related materials for educational, archival, promotional and recruitment purposes; such license includes use on school-managed platforms, in promotional materials, and in festival submissions made by the School without additional compensation to the Student.

Student assigns all right, title and interest in the production to the School (assignment selected only if expressly required by program and initialed by both parties below).

The School agrees to make commercially reasonable efforts to credit the Student in materials distributed or exhibited by the School in a manner consistent with the credit wording provided above.

Representations, Warranties and Releases

The Student represents and warrants that the production and materials supplied to the School are original or used with all necessary permissions and clearances for music, third-party footage, images and other copyrighted material. The Student will obtain and maintain releases from all performers and rights holders required for the School's uses described herein.

Use of Name and Likeness: The Student grants the School the right to use the Student's name, image and likeness in connection with the uses permitted by this Agreement. The Student understands that such uses include promotional and archival purposes.

Indemnification and Insurance

The Student agrees to indemnify, defend and hold harmless the School, its officers, employees and agents from any claim, demand, loss or liability arising out of breach of the Student's representations, failure to obtain releases or the Student's negligent or intentional act in connection with the production. The School's liability for claims arising from the School's gross negligence or willful misconduct is not limited by this paragraph.

Insurance: The School may require proof of liability insurance for certain productions. If requested, the Student will procure and maintain the insurance required by the School for the duration of the production activities.

Termination, Amendment and Governing Law

This Agreement may be terminated by the School for failure to comply with safety rules, facility policies, applicable law, or the School's academic policies. Either party may terminate for material breach if the breach is not cured within a reasonable period after written notice. Amendments to this Agreement must be made in writing and signed by both parties.

This Agreement will be governed by the laws of the jurisdiction in which the School is located, without regard to conflict of law principles. Disputes arising under this Agreement will be resolved first through good-faith negotiation between the parties, and if unresolved, by the dispute resolution process designated by the School.

Acknowledgment and Academic Considerations

The Student acknowledges that participation in the production may be subject to academic evaluation and program requirements. The Student agrees to comply with the School's code of conduct, academic integrity policies and any course requirements associated with this production.

Request for Course Credit: If course credit is requested, the Student must obtain faculty supervisor approval and satisfy the academic requirements specified by the department.
