What a Student Tutoring Agreement Covers

A Student Tutoring Agreement is a written contract that sets out the scope, schedule, fees, responsibilities, and legal relationship between a tutor (or tutoring provider) and a student or the student’s guardian. It defines services provided (one-on-one, group, online, in-person), program length, session frequency, cancellation and rescheduling rules, payment terms, and confidentiality obligations. The agreement also identifies signatory parties, any materials or technology required, and dispute-resolution or governing-law clauses to clarify expectations and limit misunderstandings during the engagement.

Why formalize tutoring arrangements in writing

A clear agreement reduces disputes by documenting expectations for performance, scheduling, payment, and data handling. It protects both tutor and family by assigning responsibilities, limiting liability, and establishing processes for cancellations, refunds, and record retention under applicable law.

Why formalize tutoring arrangements in writing

Who commonly completes a Student Tutoring Agreement

Tutors, tutoring companies, parents or guardians, and school administrators use this agreement to document private instruction and program delivery.

  • Independent tutors setting recurring one-on-one sessions with a minor for academic support.
  • Tutoring centers or companies onboarding new students into multi-session programs or packages.
  • Schools or districts arranging third-party supplemental instruction or vendor-led tutoring services.

Use a written agreement whenever fees, recurring sessions, or sensitive student records are involved to create predictable, enforceable terms.

Typical signatories and their roles

Tutor / Provider

The individual tutor or authorized representative of a tutoring company who delivers services and accepts payment terms. The provider is responsible for delivering agreed instruction, maintaining any required certifications, and complying with privacy obligations such as FERPA or HIPAA when applicable.

Student / Guardian

The student when of legal age, or the parent/guardian signing on behalf of a minor. This party agrees to payment, scheduling rules, and behavioral expectations and provides consent for any data-sharing or recording of sessions.

Essential clauses to include in the agreement

A professional Student Tutoring Agreement should be concise but comprehensive, covering administrative, operational, and legal terms that shape the tutoring relationship.

Describe subject areas, session length, delivery method (in-person/online), objective metrics, and any deliverables such as assessments or progress reports.

Schedule & Location

Specify session frequency, start/end dates, timezone for remote sessions, make-up session rules, and whether sessions can be rescheduled by either party.

Liability & Termination

Limitations of liability, indemnification language, grounds for early termination, and required notice periods for ending the agreement.
