Additional Terms and Conditions

1. Effect of Amendment. Except as expressly amended by this Amendment, all terms, covenants and conditions of the original Training Contract shall remain unchanged and in full force and effect. In the event of any conflict between the original Training Contract and this Amendment, the terms of this Amendment shall control to the extent of the conflict.

2. Student Obligations. The Student shall comply with all attendance, assessment, conduct and academic integrity requirements set forth in the original Training Contract and the Provider's policies, as amended. Failure to satisfy revised requirements shall constitute a breach of this Amendment and the original Training Contract.

3. Provider Obligations. The Provider shall deliver the amended training services in a professional manner consistent with industry standards and the program description set forth herein. Any change to delivery method (in-person, remote, blended) must comply with applicable regulatory requirements.

4. Cancellation and Refunds. Refund entitlements and cancellation procedures shall be governed by the Provider's published policy as incorporated into the original Training Contract, except as modified by the payment and refund terms provided in this Amendment.

5. Default and Remedies. A party shall be in default if it fails to perform any material obligation under this Amendment or the original Training Contract following written notice and a reasonable opportunity to cure. In case of default, the non-defaulting party may pursue all remedies available at law or in equity, including suspension of training services and collection of unpaid fees.

6. Representations and Authority. Each party represents and warrants that it has full power and authority to enter into this Amendment and to perform its obligations hereunder, and that the person signing this Amendment on its behalf is duly authorized to do so.

7. Governing Law and Dispute Resolution. This Amendment shall be governed by the laws of the jurisdiction in which the Provider is located. The parties agree to attempt good faith negotiation of disputes, and, if unresolved, to pursue non-exclusive mediation before initiating litigation, unless a party seeks injunctive relief.

8. Entire Agreement; Amendment in Writing. This Amendment, together with the original Training Contract, constitutes the entire agreement between the parties with respect to the subject matter hereof. Any further amendment must be made in writing and signed by authorized representatives of both parties.
