What the Tutor Agreement Form Is and when it’s used

A Tutor Agreement Form is a written contract that defines the relationship between a tutor and a student, family, or organization. It documents the services to be provided, payment terms, scheduling, cancellation and rescheduling policies, confidentiality and intellectual property rights, and requirements for background checks or credentials. The form sets expectations, reduces misunderstandings, and creates an evidentiary record useful for billing, tax reporting, and dispute resolution. It can be used for one-off sessions, recurring lessons, short-term packages, or ongoing instruction and is typically signed before services begin.

Why use a Tutor Agreement Form and its legal standing

A clear written agreement protects both parties by defining scope, fees, and remedies; it streamlines onboarding and supports independent contractor classification and tax reporting. Electronic signatures are generally enforceable under the ESIGN Act (15 U.S.C. ch. 96) and UETA where adopted, though some narrow exceptions apply.

Why use a Tutor Agreement Form and its legal standing

Who typically completes and signs a Tutor Agreement

Tutors, parents or guardians, school representatives, and hiring organizations commonly use this form to document instruction arrangements before work begins.

  • Independent tutors and tutoring businesses who need written terms to invoice, schedule, and define deliverables.
  • Parents or legal guardians contracting for minor students, responsible for consent and payment.
  • Schools, districts, or learning centers that contract external tutors for remedial or enrichment services.

Each signer should keep a signed copy; organizations often retain the record for payroll, tax, and compliance purposes.

Common mistakes to avoid when preparing the Tutor Agreement

  • Leaving service scope vague, which creates disputes over session content and deliverables.
  • Failing to specify cancellation and make-up policies, leading to contested refunds and scheduling conflicts.
