What a Volunteer Employment Agreement Is and Covers

The Volunteer Employment Agreement is a written contract that documents the terms under which an individual provides services to an organization without regular pay. It defines role and duties, expected schedule, duration, performance standards, confidentiality and intellectual property provisions, and any expense reimbursement. The agreement clarifies that the relationship is volunteer-based, not an employment relationship for wage-and-hour purposes, and it addresses liability allocation, insurance, and background checks when required. It also specifies termination procedures, signature blocks for parties, and applicable governing law to reduce legal ambiguity.

Why organizations use a Volunteer Employment Agreement

A Volunteer Employment Agreement reduces ambiguity by documenting responsibilities, risk allocation, and expectations for unpaid service. It helps organizations manage compliance with labor and safety laws, supports insurance claims and background screening, and provides clear terms for liability, confidentiality, and termination.

Why organizations use a Volunteer Employment Agreement

Typical users and stakeholders

Organizations and volunteer coordinators use this agreement to set formal expectations and document risk control procedures for unpaid contributors.

  • Nonprofit program directors who coordinate volunteer schedules, training, and screening.
  • Human resources or risk managers documenting liability, insurance, and indemnification terms.
  • Event organizers and community groups using short-term volunteers for projects or outreach.

Volunteers and supervising managers also rely on the agreement to clarify duties, confidentiality obligations, and termination rights.

Core clauses every Volunteer Employment Agreement should include

Core clauses in a Volunteer Employment Agreement establish roles, time commitments, confidentiality, liability limits, background checks, and dispute resolution procedures.

Role and Duties

Describe volunteer tasks, expected hours per week, supervisory chain, required training, and any performance standards, including start date and primary contact to avoid scope creep and misclassification risks.

Term and Schedule

Specify effective date, duration, regular schedule, and process for schedule changes. Clarify whether commitments are ongoing, seasonal, or single-event and include notice requirements for early termination.

Confidentiality

Include nondisclosure clauses covering client data, donor information, trade secrets, and operational procedures. Define permitted disclosures and duration of confidentiality obligations after service ends, and specify any required return or destruction of materials.

Liability & Insurance

State whether the organization maintains general liability and volunteer accident insurance, any limitations on volunteer liability, and procedures for reporting injuries or incidents, and include indemnity language and insurance contact details.

Background Checks

Specify if criminal, reference, or driving-record checks are required, the timing of checks, who pays for them, and how results affect placement or termination, and state compliance with state privacy laws.

Signatures

Provide signature blocks for the volunteer and an authorized organizational representative, include printed names, titles, and date lines; note any witness or notarization requirements and explain consequences of unsigned agreements.
