Release of Liability, Assumption of Risk and Indemnity Agreement in favor of a Lodge, Motel or Hotel regarding Recreational Activities in an Adjacent River BY SIGNING THIS RELEASE AGREEMENT YOU WILL WAIVE OR GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY ! Release and Agreement executed on the ___ day of __________, 20____ by _________________________ who resides at _________________________________ (street address, city, county, zip) in favor of _________________________ , located at __________________________________________________ (street address, city, county, zip), hereafter referred to as “Lodge.” I, _________________________, hereby acknowledge that I am a guest of the Lodge and either will or may use the _________________________ (name) River (hereinafter called “River”) adjacent to the Lodge for recreational activities. I am aware that participating in recreational activities in river is a hazardous activity, and that I am voluntarily participating in this activity with the knowledge of the dangers involved and I hereby agree to accept, and I do hereby assume, any and all risks of injury and death . For and in consideration of being permitted to stay in said Lodge, and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, I hereby agree that I, my heirs, legal representatives and assigns will not make a claim against, sue, or prosecute Lodge for injury or damage resulting from the negligence or other acts, howsoever caused, by any employee, agent or contractor of Lodge, as result of my participation recreational activities at or around River. In addition, I hereby release and discharge Lodge from all actions, claims or demands that I, my heirs, legal representatives or assigns now have or may hereafter have for injury or damage resulting from my participation such recreational activities. I further agree to indemnify, save and hold Lodge harmless from any loss, liability, attorneys ฀ fees, damage, or costs that it may incur arising out of or related to staying in said Lodge or participating in recreational activities in or around said River whether caused by the negligence of the Lodge or otherwise. I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and a contract between the Lodge and the undersigned, and I have signed it of my own free will.
