Fill and Sign the Waiver Ride Form

Waiver and Release in Favor of Organizer of Bike Ride Agreement made on the       day of       , 20       , between       , referred to herein as the Organizer, and (Name of Organizer)       , referred to herein as the Participant; (Name of Participant) Whereas, pursuant to his website located at www.       .com, Organizer has organized a bike ride, to be held on       at       ; and (Date) (Location) Whereas, for and in consideration of being allowed to participate in said bike ride, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned agrees as follows: 1. To the best of my knowledge and belief, I am in good physical condition and fully capable of participating in said bike ride. 2. I am fully aware of the risks and hazards connected with this activity, including physical injury or even death, and hereby elect to voluntarily participate in this bike riding event. 3. I HEREBY VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISK OR LOSS, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING DEATH that may be sustained by me or loss or damage to property as a result of my participating in said bike ride. 4. I hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Organizer and further agree that the Organizer is free from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in said bike ride. In giving the foregoing, I hereby waive any and all rights which I may have to make any demands and claims against the Organizer and the same are forever barred. It is my expressed intent that this release and hold harmless agreement shall bind me, my heirs, assigns and personal representatives, and shall be deemed as a RELEASE, WAIVE, DISCHARGE, and CONVENANT TO NOT SUE the Organizer. 5. Helmets are an important safety device and are required in the participation of this bike ride. 6. I am aware that with any bicycle related activity, there are certain inherent dangers, including but not limited to the hazards of roads, off road terrain, accidents, actions of participants and other persons. By my participation in this bike ride, I certify that I am aware of these inherent dangers of bicycle riding and the safety rules of the road applicable to bicycles. I agree to follow the rules of the road and all applicable laws and safe bicycling practices. _____________ Initials of Participant Page 1 of 2 8. I hereby consent to emergency medical treatment if I am injured while participating in this bike ride. 9. I understand and agree that the Organizer has reserved the right to remove any rider who is deemed to be endangering himself, herself or others, or is riding illegally as defined by       traffic laws. Notwithstanding this sentence, I understand and agree (Name of State) that Organizer is not responsible for cyclists not removed from the bike ride for any of these reasons and this clause shall in no way supersede, exempt participants from, or otherwise nullify any other clause in this Waiver and Release. 10. I understand that the terms of this document are contractual and not a mere recital and I have signed this document as my own free act. 11. I UNERSTAND AND AGREE that phrase “bike ride” is deemed to include both on the road and off the road bicycling, including mountain biking. I AGREE I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS WAIVER and RELEASE and that I AGREE TO ITS TERMS. WITNESS my signatures as of the day and date first above stated.
