IN THE CHANCERY COURT OF COUNTY, MISSISSIPPI and AS NEXT FRIENDS AND ON BEHALF OF , MINOR CHILD NO. PRELIMINARY REPORTOF GUARDIAN AD LITEM The undersigned, , attorney at law, was appointed Guardian Ad Litem by Honorable , Chancellor, Chancery Court District, for , a minor child born , , on , , , in conjunction with an emergency hearing which had been noticed in this cause by the defendant, . alleged in his/her Motion that , the minor child, was in need of immediate admission to in , Mississippi, and that the Plaintiff, , although having been ordered in the Judgment of Divorce to maintain health insurance coverage on said minor child, had failed to keep said coverage in force and effect, and that as a consequence thereof there were no available funds to pay for ’s treatment at , and that the Court should require the Plaintiff , to immediately pay the costs of ’s treatment at until could be approved for and accepted by Medicaid. The testimony at the hearing was to the effect that did not presently have any health insurance covering , but had made arrangements to obtain such coverage the day after the hearing, but admitted that such new coverage would not pay for ’s treatment at since it constituted a pre -existing condition. The Defendant testified that his/her present husband/wife has coverage for , but that would not pay for the particular type of medical treatment which presently requires. The Defendant further testified that he/she had attempted to obtain Medicaid coverage for , but that such coverage might take up to ( ) days before it became effective. There being no present insurance coverage which would pay for any treatment for at , testimony was elicited concerning ’s earning capacity and his/her living expenses incident thereto. It seemed apparent to the undersigned Guardian Ad Litem that Mr./Mrs. barely makes enough money to pay his/her present living expenses and certainly nothing above and beyond those expenses nearly approximating the $ or so per month which in-patient treatment at costs. The Court took under advisement the issue of payment of ’s medical expenses for the undersigned to make an investigation concerning possible sources or avenues of funds or insurance coverage which would pay for such treatment.Following the hearing, the maternal grandmother of namely, Mr./Mrs. , voluntarily offered to pay the cost of ’s treatment at until could be approved for Medicaid. This offer seemed to be acceptable to all parties, the parents and grandparents of , and in accordance therewith, Mr./Mrs. did pre-pay a month's treatment for at and has been voluntarily admitted to . Certain questions have arisen concerning the necessity for ’s in -patient treatment at . The grandparents, even the grandmother who paid for the treatment, have subsequently questioned the necessity or propriety of being admitted as a full-time in-patient at or any other juvenile mental facility. Although the undersigned Guardian Ad Litem has not had an opportunity to confer with the minor child directly, because of the short time in which the undersigned has served in such capacity and because of the geographical distance between County and County, where is presently residing, the undersigned has had an opportunity to review certain medical records and to have an extended conversation with , a licensed social worker and County coordinator, to whom this case has previously been referred. It is the opinion of , after having reviewed ’s medical records and having discussed his/her situation with his/her family and certain of his/her therapist that in-patient confinement at is mandated for his/her treatment and potential recovery. The undersigned Guardian Ad Litem concurs in the opinion of the coordinator, that it would be in the best interest of to receive in -patient treatment, at least for the short term. ’s father and paternal grandparents do not concur in the necessity for ’s in-patient treatment at , or his/her previous placement at , and do not believe that his/her best interests are being served by confinement in either of those facilities. However, none of the parents, grandparents, or even the undersigned are licensed medical doctors, nor are any of those same persons, including the undersigned specifically trained in dealing with adolescents who are presently experiencing the particular problems that have surfaced in . The Guardian Ad Litem believes that in the best interest of and his/her hopeful rehabilitation to serve as a reasonable, functioning adult in future society, his/her present confinement at is mandated.I do not believe that it would be in ’s best interest for him/her to continue at for a number of months without any type of independent evaluation or some type of intervention to evaluate his/her progress, and I believe that this Court should monitor his/her situation by setting this matter for review some six weeks from now so that his/her progress, or lack of same can be charted and reviewed to reconsider and redetermine whether his/her continued placement at would be in his/her best interests.There was an allegation made by at the emergency hearing on , , that his/her visitation rights had been terminated by the Court. However, in reviewing the Court file and the orders and judgments contained therein, I find no such restriction having been made by the Court. I do see that the Court ordered that visitation by both parents and other interested parties be allowed only under the terms of the visitation policies of the particular hospital or institution where was presently confined, and I believe that such visitation arrangements should continue to be set according to the policies of until further order of this Court.In summary, the issue of the payment of ’s treatment having been rendered moot on account of his/her maternal grandmother's offer and agreement to pay for his/her treatment, the Court should continue this matter for a hearing some six weeks or so from now to determine whether or not, in ’s best interest, there is a continuing need for his/her treatment at , or if a less restrictive measure or manner of treatment could be employed, based upon hopeful improvement in his/her condition at that time.
