Agreement between Unmarried Individuals Page 1 of 5 Agreement between Unmarried Individuals to Purchase and Hold Residence as Joint Tenants with Right of Survivorship This Agreement is made as of the day of , 20 , by and between of , (Name of John Doe) (Street Address) , hereinafter called Doe, and , (City, County, State, Zip Code) (Name of Jane Smith) of , hereinafter called Smith, both of whom are (Street Address, City, County, State, Zip Code) over the age of twenty-one (21) and unmarried. Whereas, Doe and Smith have acquired or are about to acquire a house and lot, hereinafter called the Property, situated at , more (Street Address, City, County, State, Zip Code) particularly described in Exhibit A attached hereto and made a part hereof; and Whereas, it is the intention and desire of Doe and Smith that the described Propertybe owned by them as joint tenants with right of survivorship, with each tenant to own an undivided one-half interest in the Property. NOW, THEREFORE, for and in consideration of the terms and covenants of thisAgreement, and other valuable consideration, the receipt of which is acknowledged, the Parties agree as follows: 1. The Parties shall create a joint tenancy with right of survivorship in and to the Property described above by executing a Deed, a copy of which is attached hereto as Exhibit B and made a part hereof and whereby John Doe and Jane Smith
Agree to sell, transfer, mortgage and convey the property to doe, and smith agrees to purchase it at the price thereof. Each one of doe and smith agrees to pay this price by cash or securities for cash of legal tender, certified checks payable directly into the name of doe shall be accepted by her, either bank checks, certified cheques payable into her own name, or credit cards or debit cards to be made payable directly therewith by her, and the price of such purchase shall include the fair market value of all improvements, improvements, improvements and improvements and fixtures which doe and smith are liable to pay for with the proceeds of such price. 2. A receipt (a copy hereof is attached hereto as exhibit b and made a part hereof) of every deed, agreement, deed by which any of the foregoing terms and covenants are binding on John Doe and jane doe . Shall be given to doe and smith, who shall sign it and attach thereto their copies. 3. If doe or smith desire to sell or transfer of any part of the property in consideration of the transfer of the property to doe, doe and smith shall execute deeds for such portion of the property, as is necessary for that purpose at the price in effect from it being acquired by them, and if they are married or living as married tenants by the time of transferring the property to doe, they shall execute separate, separate deeds for such portion of the property, or at the price in effect from it being acquired by them, respectively. 4. The party having purchased the property under this agreement acknowledges, acknowledges and agrees, that he has obtained the title to it from his spouse, his son or daughter by whom he was lawfully living on the date hereof, or from his or her son or daughter by whom he is legally adopted, and further acknowledges and agrees that he or she is in full possession of the property and that he or she intends the property to be his or her permanent residence. 5. It is understood that this agreement shall be treated as a gift of the property to doe and smith. 6. No other provisions relating to the property described above and to the transfer or sale thereof are contained in this agreement, and the parties acknowledge and agree that neither doe and smith will thereafter use nor hold any part of the said property without the previous written consent and concurrence of the other party under this agreement. 7.
