Whereas, Neighbor is the Owner of real property commonly known as ______________ __________________________________ (address of Neighbor), having Tax Account No. ____________________ (tax account number of Neighbor), more particularly described in a deed recorded in __________________________ (recording information for property of Neighbor), which adjoins the Owner's Property ______________________________________ ____________________ (Neighbor's Property). Whereas, there is a ___________ (number of feet) feet ________________________ (type of encroachment) encroachment on the __________________ (direction of compass) boundary line of Owner's Property (the encroachment). Whereas, the parties wish to establish the common boundary line between Owner's Property and Neighbor's Property; Now, therefore, for and in consideration of the premises and mutual promises made in this Agreement, and other good and valuable consideration by each of the parties to the other in hand paid, the receipt and sufficiency of which is acknowledged, the parties covenant and agree as follows: 1. Neighbor hereby conveys releases and quitclaims to Owner and Owner's successors
(name and addresses of parties, names and addresses of occupants or respective heirs or legatees, and description of premises) to the owner at the owner's expense, the following as an exchange for the owner's interest in and right to real property commonly known as (address of owner's property), having tax account no. (tax account number of owner), and property shown on the survey map attached hereto as exhibit a. 2. Owner agrees to pay (tax account number and name of owner) (name of occupant or respective heir or legatee of owner) two hundred dollars () for each such release and quitclaim or quitclaim of interest. 3. Owner understands that the provisions of this agreement as to this release and quitclaim and the release and quitclaim will be governed by the laws of the state of New York, without regard to any principles or rules of evidence and, in the event of any conflict or conflict between provisions hereof and the federal and New York state laws, the new york law shall control, unless otherwise agreed by both parties, and both parties further agree that any cause of action arising out of, relating to or in connection with this agreement shall be instituted against the law of the state of New York. 4. Owner agrees that, notwithstanding the existence of covenants herein contained which would preclude or restrict the covenants of general performance applicable to or implied by this agreement, owners' obligations hereunder are not subject to a covenant of general performance. 5. The parties further agree, with the mutual consent of the other parties, that in the occurrence of any contingency or any event or condition which they may both know, or have occasion to know, causes the other party to give notice of notice to the other party by a person or persons authorized to do so by the law of the state to which the parties are subject. 6. Owner agrees to execute, file, and deliver the affidavit of non-solicitation of a non-owner or non-owner's agent to the other party containing the written statement at the time of the signing of this agreement that in the event of a failure or delay in making a required sale of such property pursuant to this agreement, such owner shall not be entitled to such property without such owner providing a written statement of such non-sale. 7. This agreement is a contract for sale between the parties and, if any party breaches or fails to perform such contract, this agreement will be terminated as to that party by the other party as follows: (
