Fill and Sign the Agreement Common Form

Agreement between Adjoining Landowners Regarding Construction of Common Stairway Agreement made on the __________________ (date), between __________________ of _____________________________________________ (street address, city, county, state, zip code), referred to herein as Doe; and __________________ of _____________________________________________ (street address, city, county, state, zip code), referred to herein as Smith. For and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Doe agrees to construct a stairway on the __________________ (north/south/east/west) side of his lot, on the __________________ (north/south/east/west) side of the public square in __________________ (name of city), __________________ (name of county), __________________ (name of state), at least __________________ (number) inches in the clear, with the hall on the second floor running to the rear end of the building, with a door in the rear end of the hall. 2.Smith, for the use of the hall and stairway jointly with Doe, agrees to build a middle wall of good stone foundation and a brick wall two stories high for _______ (number) feet and one story high for _______ (number) feet; this brick wall is to be built half on each party's ground, and to be owned jointly by the parties, and Smith agrees to pay half of the cost of a roof over the hall, and to put wrought iron doors on each opening that he may make in the partition walls. At the completion of the stairway and hall, each party shall pay half the expenses of keeping the stairway and hall in repair.
