A. Defendant would affirmatively show that he/she was forced to vacate the premises due to the fact that the building was not suitable for the operation of because of sewer problems and rats entering into and upon the premises making the property unsuitable for the operation of a grocery store due to unsanitary conditions and the fact that rats were destroying the merchandise and frightening customers. B. Defendant would further show that the Health Department advised Defendant that he/she would have to discontinue the       because of the uncleanliness conditions caused by the rats. 4. Defendant denies the allegations of Paragraph 4, and would affirmatively show that the failure to maintain the property in a suitable condition was the cause of the termination of said lease. 5.
