BAREBOAT RENTAL AGREEMENT This Bareboat Rental Agreement dated the _____ day of ___________ 19____ between COLLAR CITY CHARTERS, INC., hereinafter referred to as Collar City Charters and _________________________ hereinafter referred to as the Captain. CONDITIONS OF RENTAL 1.Collar City Charters will provide a walk-through orientation of the Boat with the Captain.2.Collar City Charters will provide an explanation of equipment for dockside use including heat, lights, cooking facilities, refrigeration, toilets, shower, and storage.3.Collar City Charters will provide instruction for starting and stopping the engine, operation of the bilge pump, and checking the level of oil and coolant.4.Collar City Charters will explain all safety equipment including PFD's, fume detectors, fire extinguishers, anchors, lines, lights, engine alarms, windows, hatches and LPG alarms.5.Collar City Charters will provide instruction in the basic navigation Rules of the Road and will provide a printed reference guide.6.The instruction supplied by Collar City Charters will include procedures for requesting passage through locks and lift bridges.7.Collar City Charters will supervise the Captain through one full lock cycle, docking and cast-off.8.Collar City Charters cannot, and therefore does not, accept any liability for loss to the Captain's or passenger's property, baggage, motor cars, etc., or injury to the Captain or passengers, however caused, and the Captain hereby indemnifies and holds Collar City Charters and its agents harmless in all respects and under all circumstances connected with this Rental Agreement, navigation and the use of the vessel.9.Collar City Charters will not be held liable for any delays or non-fulfillment of this rental agreement caused by breakdowns, unforeseen defects, obstructions, water shortage, acts of God, repairs or damages to either Collar City Charter's boats or the waterway system.10.If Collar City Charters cancels this agreement at any time prior to casting off, or is unable to provide the boat booked or a suitable alternative, Collar City Charters will refund all money paid in advance and the Captain shall have no further claim. 11.The Captain will be asked to check the inventory and verify it is complete and to sign a statement that he/she has reviewed and confirmed that all systems are in proper operating condition.12.Procedure and vessel information is placed aboard all vessels. The Captain represents and warrants that prior to casting off he/she shall properly captain the boat and assume the accompanying responsibility.13.Cast-off and Docking will be done by the Captain as will full locking procedure (both up and down lock).14.The Captain will receive instruction until he/she is confident that he/she shall properly captain the boat and assume the accompanying responsibility.15.The Captain shall represent and warrant that he/she possesses proficiency and expertise in managing and navigating the boat and shall operate the boat in a safe and prudent manner.16.The Captain is solely and fully responsible for the safety of his/her passengers and the vessel.17.The Captain will provide Collar City Charters with a signed blank credit card imprint. Unless charges for actual damage to, or loss of the vessel and inventory are incurred by the Captain, this will be returned to the Captain two (2) days after the Captain returns the vessel to Collar City Charters.18.The Captain agrees to return the vessel on time and in clean condition.19.Six-day rentals begin at 12:00 p.m. Saturday, departing from ___________________ and return to ____________ by 12:00 p.m. Friday. The Captain will be charged $50.00 per hour for each hour the vessel is late.20.The Vessel will at all times be operated in strict compliance with State and Federal regulations in force. The Captain represents and warrants that he/she is familiar with these regulations.21.Any fines or penalties incurred by the misuse of the vessel or its equipment are the sole responsibility of the Captain.22.In the event of an accident, the Captain must promptly notify Collar City Charters with full details and names and addresses of witnesses, and should not admit liability under any circumstances.23.The Captain assumes and agrees to pay all risks of loss to, theft to, destruction of, or damage to any boat rented hereunder, caused by negligence of the Captain or passengers. 24.The Captain agrees that at no time during his/her rental period will any illegal substance be in possession of or used by any member of his/her party or taken aboard the hired vessel. Violation of this could result in seizure of the vessel with resultant operator liability.25.The Captain undertakes not to hold himself/herself by word, deed, or implication as the agent, partner, co-owner, servant or employee or Collar City Charters.26.The Captain agrees to rent the vessel from Callar City Charters from the _____ day of ______________ 19___, to the _____ day of ______________ 19___, for the sum of _______________________ $_____________ as itemized below.27.A deposit of fifty percent (50%) of the fare is required with all reservations, with the balance due 60 DAYS prior to departure.
