No. _______________ ), claiming a Mechanic’s and/or Materialman’s lien in the amount of $ ______________ pursuant to Chapter 507 of the Hawaii Revised Statutes, upon certain properties and the improvements thereon. WHEREAS, Respondent disputes the validity of such Application for Mechanic’s and/or Materialman’s Lien; WHEREAS, Respondent is desirous of discharging said mechanic’s and/or materialman’s lien application as allowed under Hawaii Revised Statute Section 507-45. If Respondent shall pay Lienor, or cause Lienor to be paid in full or otherwise satisfy or resolve the claim of Lienor, or if Lienor’s claim is dismissed or denied or if Cash Deposit for Discharge of Mechanic’s and Materialman’s Lien Page 1 of 2 final judgment is entered against Lienor, then the remaining balance of the Cash Deposit, if any, shall be immediately returned to the Respondent; provided that this court shall retain jurisdiction over the disposition of the Cash Deposit. Respondent shall continue to have all the same rights, claims and defenses as he or she would have if the lien had not been discharged, it being the intent that this Cash Deposit serve only as security in the event that Lienor obtains judgment with respect to its claims for compensation as set forth in the aforementioned application for mechanic’s and/or materialman’s lien, and this Cash Deposit shall not be deemed an admission of fault or liability or waiver of any rights, claims or defenses of Respondent.
