Contract For Grading and Landscaping This Agreement is made this the _____day of _____________, 20___between ___________________________________ (hereafter referred to as A Contractor @ ), who operates a business at ________________________________________________________ (street address, city, state) and ______________________________________ (“Owner”) of ________________________________________________ (street address, city, state) . 1. Description of Work Contractor agrees to provide all the materials and to perform the following described work, at __________________________________________________________ (street address, city, state) , shown on the drawings entitled “Project” and described in the accompanying specifications prepared by _____________________________________________ (name of landscape architect) , acting as and referred to in this contract as Landscape Architect. 2. Time for Completion Contractor agrees that the work under this contract shall be substantially completed within ________working days after the effective date of this contract. 3. Compensation Owner agrees to pay Contractor in current funds for his performance of this contract, $______________________and to make payments on account of such work as follows: On the ________ of each month, Contractor is to submit a bill for the proportion of work completed at that date. This bill is to be made out in duplicate and submitted to Landscape Architect for his approval. Immediately upon such approval, Owner is to pay Contractor ____% of the bill presented. The balance of the contract price is to be paid by the Owner upon completion of the work. 4. Contents of Agreement Contractor and Owner agree that the specifications and the drawings, along with this agreement, form the contract, and that they are as fully a part of the contract as if they were attached to or repeated in this instrument. 5. Liens Contractor further agrees that no lien or claim of any kind whatever shall be filed by him, by any subcontractor under him, or by any other person, firm, corporation, or other entity against the property or against any other property belonging to Owner for any work or any materials furnished for the construction of the work and work incidental to such work. 6. Governing Law This agreement shall bind and inure to the benefit of the respective heirs, personal representatives, successors, and assigns of the parties, and shall be governed by the laws of the State of ____________________. 7. Attorneys’ Fees If any action is filed in relation to this agreement, the unsuccessful party in the action shall pay to the successful party, in addition to all the sums that either party may be called on to pay, a reasonable sum for the successful party’s attorney’s fees. 8. Entire Agreement This agreement shall constitute the entire agreement between the parties and any prior understanding or representation of any kind preceding the date of this agreement shall not be binding upon either party except to the extent incorporated in this agreement. 9. Modification of Agreement Any modification of this agreement or additional obligation assumed by either party in connection with this agreement shall be binding only if evidenced in writing signed by each party or an authorized representative of each party. 10.
