A petition for dissolution of marriage may be filed in district court only by the defendant if (1) the marriage lasted fewer than 12 months; or (2) the marriage is voidable; or (3) if the defendant is a minor, he or she has attained the age of 17 years and is a resident of this state. Such petition may be filed with the clerk of the district court on a form approved by the court, showing the facts of the case and setting forth the basis for the petition, and may be served and filed by the petitioner within 5 days after service of process upon him or her. A petition for dissolution of marriage under this subsection may be filed by any person or by such person's attorney, guardian, or any other person authorized to act for that person under § 26–11 of this title. (a) in counties where the petitioner resides, when the plaintiff and/or defendant are present, the filing of the petition shall proceed: (1) as if the defendant were actually present at the time of the filing of the petition; and (2) in case of failure of the defendant to appear and file in circuit court, the case shall be tried without his or her presence and upon the petition of that person. (b) if the court grants the motion of either side to be heard, the defendant and every witness to the proceedings shall be given notice and an opportunity to be heard, and shall have the burden of proof upon each and every ground of relief therein urged. The petitioner shall be notified of all objections and defenses made by the defendant, and the defendant shall be allowed to present his or her evidence; but no part of the evidence may be offered or received unless the court orders the admission of such evidence. (c) except in cases arising under subsection (b) of this section, when there are two or more parties (other than the defendant and one of the parties described in subsection (b) of this section), the petition shall be filed with the clerk of court in the county in which (i) the plaintiff resides; (ii) all the defendants reside if one or all are not present; (iii) one or more of the defendants is a minor; or (iv) the court determines that the interests of justice require a trial. (d)
