Release and Waiver Agreement By Contractor in Favor of Property Owner Regarding Christmas Decorations This Agreement is being made this the ____ day of __________, 20____, between _______________________, of __________________________________________ (street address, city, state, zip code) ( Owner ), and __________________ Contractors (Contractor ), a duly licensed contractor in _____________________ (name of state) and doing business at ______________________________________________ (street address, city, state, zip code). Whereas, Contractor has agreed to perform certain work on the premises of Owner located at ______________________________________________ (street address, city, state, zip code); and Whereas, said work will involve putting up Christmas decorations, including lighting, on the premises of Owner; and Whereas, as a condition to entering into this contract, Owner is requiring that Contractor execute a release and waiver of liability in favor of Owner; Now, therefore, in consideration of my employment by Owner to perform work on the premises of Owner, including putting up Christmas decorations and lighting, on the premises of Owner, I hereby release said Owner, from all liability for any injury occurring to me or to property in my custody, while on Owner’s premises doing said work, caused (whether negligently or otherwise) by Owner his, agents, employees, licensees, or invitees. C ontractor acknowledges that he is an independent contractor and is not an agent, partner, joint venturer nor employee of Owner. Contractor shall have no authority to bind or otherwise obligate Contractor in any manner nor shall C ontractor represent to anyone that he has a right to do so. Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
